How is the 60-day grace period for UK visa calculated after being laid off?
After being laid off with a work permit, I suggest immediately starting the new sponsorship and application preparation, and not treating the receipt of a 60-day notice as the starting point for job hunting.
60 days from which notice?
This article discusses the situation where a person in the UK with a Skilled Worker (Skilled Worker Visa) encounters a normal layoff. Home Office will consider canceling or shortening the permit; usually, 60 calendar days will be retained to apply for a new residence permit or arrange departure. This period is related to the delivery of the formal cancellation decision, and the layoff notice, end of employment contract, or employer reporting of the termination of sponsorship cannot directly serve as the starting date. In practice, the submission should be arranged based on the expiration date clearly stated in the formal decision, and the original permit's expiration date should be verified; if there are other reasons for cancellation such as serious violations, the time arrangement for ordinary layoffs cannot be directly applied.
The original visa will not be extended for 60 days: When the remaining validity of the original permit is less than 60 days, it is usually still subject to the original expiration date.
Home Office According to the guidelines C1.13 and C1.15, stopping guarantees and other related changes usually need to be reported within 10 working days. This is the deadline for the employer to submit. Confirming with HR the actual termination date and the submitted content can help verify subsequent letters, but it cannot be used to add an additional 10 days of stay. This guideline C1.17 also requires the employer to provide the address and personal contact information they have retained. Verifying them during the handover helps avoid notices being sent to the old address.
The term may be running when the email is sent.
The delivery of paper letters, emails, and service when contact cannot be made may correspond to different time records.
Home Office Supplementary Guidance for the cancellation of permits, section 2.4 clearly states that email delivery is calculated based on the date of sending; the date the email was opened will not automatically replace the sending date. For paper letters sent to addresses in the UK, when calculating the new expiration date, the mailing arrangement for physical delivery will be taken into account, and the email algorithm cannot be directly copied. After receiving the notice, keep the effective date in the main text, the sending record, and the attachment together, and then verify with the original visa expiration date; if the dates are conflicting, please have a licensed lawyer verify as soon as possible, and it is safer to prepare according to the earlier date.
If the party has not received it in person, the period cannot be deemed not to have started: when the conditions are met, Home Office may use file delivery, and the time will start from the date of such delivery.
After the job offer, you still need to complete the application.
The truly critical time to reverse is the time when the application is completed. The UK government's guide for changing employers requires that the new position meets the relevant conditions and has a new CoS (sponsorship certificate). Interviews, verbal commitments, and offer letters will not automatically extend the visa. When communicating with the employer, I recommend directly confirming who is responsible for the sponsorship, when the CoS can be issued, the job code, and whether the salary supports the application, leaving room for document verification and payment. If the other party is still applying for a sponsor license, list the license processing, CoS issuance, and personal application separately, so you can clearly see which step still has uncertainty. This way, you can determine whether a job offer can be implemented within the current validity period, avoiding filling all available time with interviews without leaving a window for submission.
If a qualifying domestic application is submitted validly before the expiration of the current permit, the Immigration Act 1971 section 3C may extend the original permit until a decision is made.
The dates for family members also need to be verified separately. If the spouse and children hold dependent permits, Home Office are usually also considered for cancellation, and are usually set to expire on the same day as the main applicant; family members need to handle their own new applications separately. If the new sponsorship cannot be completed in time, other domestic routes that have already met the requirements can be assessed simultaneously, or arrangements for departure on time can be made. Simply having interview progress, employer commitments, or explanation emails will not automatically extend the period. For special considerations such as medical needs, evidence should be submitted as early as possible, and the relevant authorities will decide whether to handle it with discretion.

Complete four things in this order
- Obtain the layoff notice and employment termination confirmation from the HR department, and verify the reporting situation of the guarantee termination.
- Check the personal contact information in the UKVI records, check for spam and whether the representative still represents you, and put the notice together with the original license expiration date on the same calendar.
- Confirm with the new employer the issuance arrangement of CoS and the job conditions, reserving time for application preparation.
- Check the family's consent for each person; if there is no plan that can be submitted on time, arrange for departure before the deadline, and file the relevant notice, submission proof or departure records in the same folder.
