Buy a house with a UK visa, how is the overseas surcharge calculated?

JustiScript•8 October 2026•👁️ 911

I think, when buying a property in the UK, overseas property ownership status and two additional taxes should be clarified in writing before exchanging contracts, and sufficient funds should also be set aside for the taxes.

Only calculate the budget by adding an "overseas buyer tax" to the property price. For families that still have housing abroad, this may result in leaving a large amount of cash behind. To determine the payment amount, it is necessary to separately account for the property location, existing ownership, and non-resident determination. This article refers to the current rules as of October 8, 2026, focusing on the Stamp Duty Land Tax (SDLT) for individuals purchasing residential properties in England and Northern Ireland; Scotland and Wales have separate tax systems, and the following process uses a typical residential transaction in England as an example.

2% and 5% may be calculated together

2% non-resident surcharge and 5% additional residential surcharge can be applied simultaneously.

HMRC's guidance on SDLT rates for non-UK residents states that a 2% surcharge is added to other applicable residential rates; the additional 5% for extra properties requires checking global property ownership, including overseas properties. Even if intending to live in it, verification is still required. There are exceptions for situations such as selling and replacing a main residence, so conclusions cannot be drawn solely based on the number of properties. When both apply, it is an additional 7 percentage points on the standard marginal rates, not a 7% multiplication of the tax payable.

The following is calculated according to the current tax rate: house price £500,000, no first-time buyer or other exemptions, purchasing a standard freehold property.

Applicable Scenarios Total SDLT
only ordinary residential tax rate £15,000
Standard rate + 2%£25,000

This exception only applies to the high tax rate for additional residences; the first-time buyer discount requires separate review.

Another page, SDLTM29845, states that the qualification for first-time homebuyer is determined by whether one has ever held a residential property right that meets the definition globally. Inheritance, gifts, and partial shares are all within the scope of review, and small amounts are not automatically excluded. Therefore, individuals who meet the above inheritance exception may not need to add 5%, but still may not qualify for first-time homebuyer exemptions. Selling that equity will not erase the "previously owned" record.

Align the documents and invoices before exchanging the contract.

My choice is to complete the accounting first and then exchange the contract, and any doubts about the tax amount should be resolved before the exchange.

In normal transactions in England, once an offer is accepted, the formal loan application, lawyer's search, and independent house inspection can proceed simultaneously. Those applying for a loan with a UK visa should confirm identity document requirements with the lender and prepare their passport, residency proof, income documents, and source of down payment. Another list to be handed over to the conveyancing lawyer specifies each buyer's global property rights, method of acquisition, shareholding, intended use of the purchased property, and residence records. According to the UK government's "How to buy a home" process, loans, necessary checks, and available funds should be confirmed before exchanging contracts; then, the tax details should be verified, and the tax, legal fees, and other expenses should be separately deducted from the down payment.

Subsequent expenditures on leased property rights should also be clarified before the exchange.

If the property is leasehold, the lawyer's report should specify the remaining lease term, service charges and ground rent, as well as any known major repair arrangements. The UK government's home buying guide also reminds that a mortgage valuation is not equivalent to an independent house survey; whether to hire an independent surveyor should be assessed based on the condition of the property, and this cost should be included in the budget.

After the Exchange (Exchange Contract), the transaction is usually legally binding, and exiting may involve compensation.

Completion (settlement) involves the final payment and obtaining the keys. SDLT filing and tax payment usually need to be completed within 14 days from the effective date of the transaction, which is generally the settlement date; early substantive performance of the contract may change the starting date. Even if the buyer entrusts a lawyer to handle it, the buyer should request confirmation of the filing and payment.
