Buy a house with a UK visa, how is the overseas additional tax calculated?

JustiScript

I think, when buying a property in the UK, overseas property ownership situations and two additional taxes should be clarified in writing before exchanging contracts, and sufficient funds should also be reserved for the taxes.

Only estimate the budget by adding an "Overseas Buyer Tax" to the property price. For families that still have housing abroad, this may result in leaving a large amount of cash behind. To determine the payment amount, it is necessary to separately account for the property location, existing ownership, and non-resident determination. This article refers to the current rules as of October 8, 2026, focusing on the Stamp Duty Land Tax (SDLT) for individuals purchasing residential properties in England and Northern Ireland; Scotland and Wales have different tax systems, and the following process uses the example of a typical residential transaction in England.

2% and 5% may be calculated together

2% non-resident surcharge tax and 5% additional residential surcharge tax can be applied simultaneously.

HMRC's guidance on SDLT rates for non-UK residents states that a 2% surcharge is added to other applicable residential rates; the additional 5% for extra properties requires verification of global property ownership, including overseas properties. Even if intending to live in the property, verification is still required. Exceptions exist for situations such as selling and replacing a main residence, and conclusions cannot be drawn solely based on the number of properties. When both apply, an additional 7 percentage points are added to the standard marginal rates, not by multiplying the tax payable by 7%.

The following calculation is based on the current tax rate: house price £500,000, no first-time buyer or other exemptions, purchasing a standard freehold residential property.

Applicable Scenarios Total SDLT
only ordinary residence rate £15,000
Standard rate + 2%£25,000
Normal rate + 2% + 5%£50,000

This example omits the additional residence item, resulting in a shortfall of £25,000 in taxes.

Inheriting a half-ownership apartment, two qualifications need to be verified

When you have overseas property, only "First-time buyer in the UK" should be filled. The tax calculated by transferring all ownership to a lawyer may differ. HMRC manual SDLTM09795 has a practical exception: if you become a co-owner of a residential property through inheritance, and the effective date of the purchase transaction is within three years after the inheritance, and your combined share with your spouse or civil partner does not exceed 50% during the relevant period, this inherited interest can be ignored when determining the additional rate for residential properties. This requirement refers to the co-ownership interest obtained through inheritance; gifts before death cannot be directly applied. When preparing documents, you need to provide inheritance documents, the date of obtaining the interest, and changes in shares. You cannot just report the current percentage.

This exception only applies to the high tax rate for additional residential properties; the first-time buyer discount requires separate review.

Another page SDLTM29845 states that the qualification for first-time purchase is determined by whether the individual has ever obtained a residential property right that meets the definition globally. Inheritance, gifts, and partial shares are all within the scope of review, and small amounts do not automatically exclude eligibility. Therefore, individuals who meet the above inheritance exception may not need to add 5%, but still may not be eligible for first-time purchase discounts. Selling that equity will not erase the "previously owned" record.

Align the materials and invoices before exchanging the contract.

If the property is leasehold, the lawyer's report should specify the remaining lease term, service charges and ground rent, as well as any known major repair arrangements. The UK government's home buying guide also reminds that a mortgage valuation is not equivalent to an independent survey; whether to hire an independent surveyor should be assessed based on the condition of the property, and this cost should be included in the budget.

After the Exchange (Exchange Contract), the transaction is usually legally binding, and exiting may involve compensation.

Completion (Delivery) refers to the completion of the remaining payment and obtaining the keys. SDLT declaration and tax payment are usually required to be completed within 14 days from the effective date of the transaction, which is generally the completion date; early substantial performance of the contract may change the starting date. Even if the buyer entrusts a lawyer to handle it, the buyer should request confirmation of the declaration and payment.
