How to appeal if the bank account of ILR is frozen?

JustiScript•3 October 2026•👁️ 797

My bank account is frozen, I can't even pay the rent, is there nothing else to do but wait for "under review"?

The guidance from the UK Financial Ombudsman Service (FOS) clearly states that you can complain about how the bank handles the frozen account. Reasons that may lead to freezing include suspicion of fraud, money laundering, or other illegal activities, as well as enforcement of court orders; unusual transactions or inability to confirm whether a payment was authorized by the individual may also trigger verification. Banks sometimes cannot disclose all reasons, and holders of UK visas or ILR (permanent residency) need to handle the freeze according to the specific reason.

You can file a complaint while cooperating with the verification and discussing the handling method.

Payment blocked and account closed, the time limits are different

The beginning of the current UK Financial Conduct Authority (FCA) "Complaints Rules" (FCA Handbook, DISP 1.6.2AR) defines the scope: complaints under the Payment Services or Electronic Money Rules. Complaints related to card payments, blocked transfers, etc., may fall under this; pure account closure disputes usually apply the general eight-week response period. The following is a breakdown according to this rule.

Confirm which functions are restricted before submitting your request.

When communicating in practice, you can break down the issue into: whether the bank card is disabled, a certain transfer is blocked, or the entire account cannot receive or make payments, and ask the bank to list the functions that are still available. Prepare identity documents such as passport, recent address proof, and the deposit evidence that may be asked; salary deposits can be accompanied by pay slips, and family support can be accompanied by remittance records and explanation of fund sources. Mark each document with the corresponding transaction date, amount and payer, keep the submission receipt and additional document requirements. Also list which materials are still missing and which have been submitted on the same list, making it convenient for checking item by item. If it is known that it involves a court order, you should ask a lawyer to verify the order and relief methods, as bank complaints cannot replace the relevant procedures.

Fifteen working days, what should be received

Article (1) stipulates that, starting from the day after receiving the complaint, the final response, i.e., final response, is usually required to be issued within 15 working days. The starting point may differ from the date when the account was frozen. Keeping the date of the first complaint and the receipt can help verify the deadline.

This time limit restricts the response to complaints, and does not guarantee that the account will be unfrozen at that time.

A written complaint can be written as follows: "I formally complain about the handling of the account restriction. The affected transactions and the submitted materials are attached. The due date and amount of necessary expenses are also listed. Please confirm the complaint number, the date of receipt of the complaint, and the applicable response period, and explain what additional documents are required and whether necessary payments can be arranged within the scope allowed by law. I also request an assessment of the actual losses caused by improper handling." Just fill in the content according to the actual situation.

When rent, food, or medication expenses are affected, attach receipts and clearly request priority processing; whether payment can be arranged still depends on the freeze restrictions.

There are conditions for extending to 35 days

Item (2) allows for exceptional circumstances to be extended: the delay must be due to reasons outside the bank's control, and the bank must explain the reason for the delay and the final response period within 15 working days; the latest is 35 working days from the day after the complaint is received. 35 working days is the total period , and it cannot be added another 35 working days after the previous 15 working days.

In the same chapter DISP 1.6.2BR, there is another detail: if a complaint involves both payment blocking and other matters, the part that meets the definition of a payment complaint must still be handled within the shorter time limit.

If you are not satisfied with the final response, you can apply for free processing with FOS. If there is no final response yet, and 15 working days have expired without a satisfactory extension response, you can escalate; if there is a compliant extended response, it is usually until 35 working days have expired. After receiving the final response, you generally need to submit it within six months from the date the bank issued the response. Keep records of failed payments, overdue fees, and correspondence. FOS will assess the basis for restrictions, whether the handling was reasonable, and the impact caused, and compensation will be considered on a case-by-case basis.

我的判断是:基本生活已受影响时,就把书面投诉和生活困难请求一并递交,不必等审核结束再表达异议。
