How to protect your rights in UK employment contract disputes? Acas mediation and arbitration time limits

JustiScript•25 September 2026•👁️ 1053

The most regrettable type of consultation is when the materials are flawless. Pay slips, schedule tables, resignation emails, two hundred chat screenshots; the issue itself is clear-cut. Ask "What day did you resign?" and they reply with a date in spring.

As soon as the date was mentioned, the stack of papers behind became only of reference value.

Whether the event occurred before or after October 1st, the time limit is doubled.

This provision is currently stuck at the time of the transfer. The Employment Tribunal (Extension of Time Limits) (Miscellaneous Amendments and Transitional Provisions) Regulations 2026 changes the time limit for most employment tribunal claims from "three months minus one day" to six months, effective from October 1, 2026. The transitional provisions look at when the "last of the relevant conduct, or a series of conduct" occurred: if it occurs on or after October 1, it follows the six-month rule; if it occurs on or before September 30, it follows the original three months minus one day.

That is, people who were fired or had their salary withheld this week are still in the old criteria.

The deadline for submitting EC notifications starting from December 1, 2025, will be extended from 6 weeks to 12 weeks. During this period, the time clock will be paused, and there will be at least one month remaining after the certificate is issued to submit an appeal. Therefore, the actual available window is slightly longer than the numbers "3 months" or "6 months".

path cost key restrictions
Early mediation Free Up to 12 weeks, voluntary for both parties, the other party may not negotiate
Employment Tribunal ET1 No application fee currently Must have an EC certificate; strictly time-bound
Arbitration Plan Acas bears the costs of arbitrators Limited to unfair dismissal; requires both parties to sign a waiver

What should you think through before signing the settlement agreement?

A settlement reached through mediation will result in a COT3. It is legally different from the settlement agreement usually provided by the company: under section 203(3) of the Employment Rights Act 1996, a regular settlement agreement becomes effective only if you first obtain advice from an independent legal advisor; whereas a settlement facilitated by a mediator falls under the exception of section 203(2)(e), and is effective without the need for independent advice.

In practical terms: a clause agreed upon verbally over a phone call will be closed once it becomes COT3, and no one will be around to check if anything is missing. It is much cheaper to list each item—unpaid wages, compensation for unused annual leave, notice period salary, and wording of the employment certificate—before signing, rather than arguing afterwards. If you are unsure about the scope of the clauses, spend £5 on justiscript.com to get a written response from a qualified English lawyer within 24 hours regarding one specific issue; it's enough to help you decide whether or not to sign.

"Acas arbitration" and the Employment Tribunal are two different things.

In Chinese, "arbitration" is often used to refer to the employment tribunal itself, which can be confusing. Acas has another real arbitration scheme (under SI 2004/753), where after both parties agree and sign a waiver, an Acas arbitrator holds a private hearing and makes a binding decision, with compensation standards the same as in court, but with very little room for appeal - only on very narrow legal points such as human rights law, and whether the arbitration itself was valid or whether the dispute was within the scope of the scheme.

My judgment is that this route is not worth choosing for most Chinese people in the UK. The scheme covers only unfair dismissal, but not discrimination, unpaid wages, or breach of contract, which are often linked to dismissal; once you sign a waiver and later find that your claims are inseparable, it will be very difficult to go back. The effort should be put on the 12-week mediation, while also scheduling the submission date of ET1 according to the shortest time limit, and if the other party is unwilling to negotiate, submit it according to the scheduled date.

Still employed, but wants to claim the money in the contract, where should he go?

This step is easy to miss. The authority of employment tribunals to hear breach of contract claims comes from The Employment Tribunals Extension of Jurisdiction (England and Wales) Order 1994: Article 3 requires that the employment has ended, and Article 10 sets a maximum limit of £25,000 for compensation under the same contract. If the person is still employed and wants to claim money that is specified in the contract but not paid (such as agreed bonuses, overtime pay, and car allowances), a simple breach of contract claim should go to the County Court, with a limitation period of 6 years under Section 5 of the Limitation Act 1980, which is much more lenient. There is one exception worth remembering: if wages are underpaid or unlawfully deducted, it can be claimed in the employment tribunal under Part II of the Employment Rights Act 1996 as "unlawful deduction of wages," without needing to resign first.

The formal first step in going to the county court is a Letter Before Action that complies with the CPR pre-action protocol. On justiscript.com, £5 can be used to draft a formal pre-action letter on law firm letterhead, and many disputes are resolved upon receiving such a letter.

Visa status and this procedure are two separate issues: the appeal itself does not affect the permit, but the expiration date of the permit will limit how long you can wait, so the negotiation pace should follow it. This article is for reference only; for specific issues, please consult a licensed attorney.

Back to the original date issue: If the matter on your hand happened in September, are you going to submit the EC notification before October 1st, or wait until it's clear? This choice directly determines whether you take 3 months or 6 months. Feel free to comment in the comments section about where you're stuck.
