How to file a small claims lawsuit in the UK? No need to hire a lawyer for less than £10,000
When the deposit was returned, the landlord withheld 800 pounds and said "there were scratches on the wall"; I ordered a second-hand camera online and paid for it, but the seller disappeared after taking the money; I paid a deposit for someone to decorate, but half of the work was done and the person ran away... The first reaction of many Chinese people is "It's too expensive to hire a lawyer, forget it." But in fact, the UK has a Small Claims Track system specially designed for ordinary people - for disputes under 10,000 pounds, you can submit them online yourself without hiring a lawyer. How much can a small claims lawsuit cost in the UK? What can be sued?
According to Part 27 of the Civil Procedure Rules (CPR), most disputes where the amount of does not exceed £10,000 will be assigned to the "small claims track". Common applicable scenarios:

How much does a small claims lawsuit cost? The latest fees in 2026
This is what everyone is most concerned about. There are only two statutory fees in small claims litigation: issue fee and (if a trial is held) hearing fee. The filing fee is divided according to the claim amount (as of November 2025 GOV.UK fee schedule):
• Up to £300: £3,000–£5,000:£205
• £5,000–£10,000:£455
Online filing (Money Claim Online / Online Civil Money Claims) is faster and cheaper than paper filing. If there is a court hearing, there will be an additional hearing fee of £27-£346. The key point is: after winning the lawsuit, the court will usually order the defendant to return to you the court fees you advanced.

UK small claims litigation process: do this before filing a lawsuit
Don’t rush to file a case. The court requires you to send a formal "Letter Before Claim / Letter Before Action" (Letter Before Claim / Letter Before Action) before filing a lawsuit, stating clearly: how much you owe, why, and requiring the other party to pay within a few days (usually 14 days), otherwise it will sue. Many people paid the bill obediently after receiving this letter, and even avoided filing a lawsuit.
The other party still ignored it and went online to submit a claim again. The subsequent process is roughly as follows: the defendant has 14 days to respond after receiving it → If you admit, you will pay and close the case; if you plead, you will enter → The court usually arranges free telephone mediation (mediation) → If mediation fails, the court will be scheduled. The entire small-amount track is deliberately designed to be "lawyer-free". The judge will actively guide both parties, so there is no need to worry about not understanding legal terminology.
💡 A major feature of small claims litigation (CPR 27.14): Even if you win, you generally cannot ask for attorney fees from the other party - so it is not cost-effective to hire a lawyer for this type of case, and it is most economical to fight it yourself. However, if the other party behaves "unreasonably", the court may make an exception and award part of the costs.
How to retain evidence? The key to winning is before trial
The outcome of a small claims lawsuit depends 90% on the evidence. From the first day of the dispute, keep all written traces: contracts, receipts, bank transfer records, screenshots of WeChat/WhatsApp/email chats, photos and videos of the house when checking in and out (with timestamps), reminder letters and proof of delivery. Verbal promises are difficult to prove. If it comes down to words, then it will be in words.
One more thing to evaluate: the other party has the ability to repay the money . If you win the lawsuit, you only get a judgment. If the other party is a shell company or has run away, you will have to go through enforcement later, which will be more time-consuming. Before filing a lawsuit, consider the other party's solvency. Don't lose face if you win.
For Chinese in the UK, small claims litigation is a seriously underestimated "rights protection tool." It does not require you to be proficient in British law, it only requires you to retain evidence and follow the process. You can really get your grievances within 10,000 pounds back by yourself.
