ILR goes back to the UK for a few days, does he need a tourist visa?
There is already ILR, this trip will only stay in the UK for a few days, does that mean I need to apply for another tourist visa?
Home Office's updated "Lapsing leave and returning residents" section 2.4, effective August 4, 2026, clearly states that those who still hold permanent residence and return to the UK within the allowed period of absence should not be granted a visitor visa even if this visit is only short. The following are five things to check before departure according to current guidance.
1|ILR is valid, return to the UK under the original identity
I think that those who confirm ILR is still valid should directly prepare for the short-term return-to-UK check as a permanent resident, it's not worth applying for a tourist visa just for "staying a few days".
The applicable premise is that the person still holds an valid ILR at the time of returning to the UK, and there are no other circumstances that would cancel or refuse entry. Returning for the purpose of visiting relatives or vacation, describes this trip; Visitor (Visitor) refers to the immigration category. Upon entry, it is possible to truthfully state that they will stay for only a few days, and provide the existing permanent residency proof. There is no need to treat oneself as someone who needs to re-apply for a visitor visa just to accommodate a short trip, nor to describe visiting relatives as living permanently. This article mainly discusses those who have obtained a regular ILR through work, family, etc. If accompanying family members have not yet obtained permanent residency, they still need to prepare documents according to their own permits, and cannot apply the conclusions of this article together.
When the above conditions are met, it can be stated as: "I hold a valid permanent residency permit, I have returned to visit relatives, and I plan to leave according to the itinerary."
2|The two records should match.
Whether the above wording can be used depends on whether the permanent residency has expired due to long-term absence. According to the current "Immigration Rules" Appendix Returning Resident, a general ILR usually expires after being continuously absent from the UK, the Channel Islands, and the Isle of Man for more than two years; specific statutory exceptions are assessed separately. What is suitable for putting in the travel dossier is the record of approval of permanent residency and actual entry and exit records. I suggest arranging the departure date, the dates of previous returns to the UK, and the planned return date in a row, and cross-checking with passport records and actual boarding documents. A mere booking confirmation cannot indicate that the trip has been completed.
If the itinerary is changed, the actual arrival date should be used when verifying the completed travel, and the arrival date of the canceled flight cannot be used.
3|The entry stamp does not mean re-approval
The guidance in section 2.4 has another detail that is easy to overlook: the passport of eligible travelers should be stamped with an open date stamp (open date entry stamp) according to the guidance. This stamp is used to prove arrival in the UK, but it does not grant a new residence permit. Identifying the traveler still requires combining the original permanent residency and evidence of its continued validity. If the permanent residency proof is in the old passport, the UK government's return to the UK explanation requires carrying both the new and old passports so that the current travel document can be matched with the original identity proof.
Those who enter through the electronic gate can also keep the actual travel voucher for this trip, which is convenient for future verification.
4 | Changed passport, check the association before departure
The UK government's "Travel with your eVisa" requirements state that the valid passport used for travel must be added to a UKVI account, and the account profile, electronic identity, and passenger information provided to the carrier must match accurately. For those who have obtained a new passport overseas, they can check each item one by one, including the new number, name, and validity period; if the association is still with the old document, it should be updated before traveling. You can also generate a share code (identity sharing code) for travel purposes in advance, which is valid for 90 days and can be reused during that period. If the trip is long, check before returning whether a new share code needs to be generated. If you cannot log in to the account, the official page provides account recovery methods, and specific issues can be handled accordingly.
The information is correct, but if the carrier cannot be found, you may ask the staff to contact the Carrier Support Centre of the UK Border Force.
5|If it has become invalid, it needs to be judged separately.
If your permanent residency has become invalid due to leaving the UK, and you wish to re-establish your settlement in the UK, you need to apply as a Returning Resident while outside the UK. The current Immigration Rules, Appendix Returning Resident, RR 4.1 requires a genuine intention to settle, and RR 6.1 requires maintaining strong ties with the UK during your absence. A short-term visit for family reasons is not sufficient to replace these conditions. If you are only planning a short visit, the entry requirements will be assessed under the applicable visitor rules; approval of a visitor visa will not automatically restore your previous permanent residency.
If you are unsure whether your permanent residency is still valid, you may ask a licensed attorney to verify it in conjunction with the approval notice and your travel dates. This article is for reference only; for specific issues, please consult a licensed attorney.
Home Office上述指引第2.4节,对仍保有永居、却寻求以访客身份入境的人,给边境工作人员的指令很明确。理解这句话的适用前提,短期返英时就能如实说明行程,并按现有身份准备证明:
“You must not grant entry as a visitor in this instance.”
在这种情形下,不得以访客身份准予入境。
