ILR Timeline: How long after switching from a student visa to a work visa can one obtain permanent residency?

JustiScript•29 September 2026•👁️ 953

A post-graduation stay plan can be filled starting from three dates: the date when the course ends as confirmed by the school, the date when the e-visa expires, and the start date of the job on the guarantee letter. Leave two more spaces next to it, writing the date when the work permit becomes effective and the expected date when the permanent residency requirements will be met, thus forming a rough timeline.

According to the current rules verified on September 29, 2026, the period for permanent residency eligibility for the principal applicant of a work permit is still five years.

When can student visa be converted to work visa?

The current "Immigration Rules" Appendix Skilled Worker SW 1.5A lists three entry points. The course has been completed, and application can be made based on this; when studying full-time at a compliant higher education institution for an undergraduate or higher degree, and the course has not yet ended, application can also be made under other conditions, provided that the start date of the job on the CoS (guarantee certificate) is not earlier than the end date of the course; doctoral students who meet the institution and full-time requirements have another entry point, provided that the start date of the job is not earlier than 24 months after the start of the doctoral program. When actual scheduling is carried out, the school should confirm the course duration, and then the employer should write the corresponding date into the sponsorship record, to avoid using different estimated completion dates.

The graduation date does not determine this window; the course end date, application date, and work start date each have their own purposes.

Applications can usually be submitted up to three months before the start date listed in CoS, and should be submitted before the expiration of the current permit. In practice, the school confirmed date, permit expiration date, and the employer's expected issuance date of CoS can be placed on the same line. After receiving the job offer, it is also necessary to confirm that the employer has the qualification to sponsor, the position meets the occupational requirements, and the salary and English requirements are all met; the time required for the employer to apply for the license should also be included in the plan.

Must I first get the graduate's signature?

Graduate (Graduate Visa) is an optional transition, and eligible students can directly switch to Skilled Worker (Skilled Worker Visa).

My judgment is that those who have already obtained a qualifying sponsor position and meet the transfer conditions should prioritize directly switching to a work visa, without delaying for the purpose of using up the graduate visa. Those who have not yet found a sponsor position and indeed need time to look for a job can consider the graduate visa, while recording its expiration date and subsequent job search milestones. To apply for this transitional route, one must be in the UK, hold a valid student visa, and the school must report that the required course has been successfully completed; submission must also be completed before the student visa expires.

This offer has a time limit. According to Appendix Skilled Worker SW 12.3 of the "Immigration Rules," the duration of the Graduate, Skilled Worker, and Tier 2 visas should be combined, along with the proposed visa to be approved, and the total should not exceed four years; even if these periods are not continuous, they still need to be combined. Here is a pure calculation example: if someone has held a graduate visa for two years, and has no other related visa duration, the remaining balance available for new employees' benefits would be approximately two years. The exact period needs to be calculated based on the actual start and end dates of the visa and the proposed approved period.

The four-year restriction limits the use of this benefit; after that, if eligible for another salary category, renewal application is still possible. Therefore, the end date of the benefit usually comes earlier than the five-year mark of the work permit.

Here is a detail that is easy to overlook during the processing of CoS: According to section 16.1 of the "Skilled Worker caseworker guidance," an application cannot be assessed as a new entrant for only part of the approved period. Suppose the concession balance is only enough for about two years, but the application is made for three years; the case worker cannot unilaterally shorten the visa duration without the sponsor's consent to make the application compliant. When confirming the sponsorship period with the employer, arrangements for salary after the concession ends should be discussed at the same time, rather than waiting until renewal to find out that the plans do not align.

How to arrange it in the next five years after approval?

For those who are currently in the UK on a student or graduate visa and have not previously had any other qualifying route, the five-year period starts from the date when the work visa permission is granted.

Guidance for Work Permit Case Review, Section 23.1 stipulates that the domestic residence permit takes effect from the date of decision. After obtaining approval, the timeline can be divided into three stages: confirm the start and end dates of the permit and the current sponsorship period at the beginning; before each renewal, re-verify the occupation code, salary category, and remaining benefits; when approaching five years, reconfirm the permanent residency qualification period and other conditions. If the initial permit does not cover the entire five years, it is necessary to arrange a bridging application. Budgets should also be separately reserved: there are expenses for changing work permits, necessary renewals, and permanent residency applications, and the term and costs of the first work permit should not be considered as the entire route.

In recent years, the continuous residence requirement applies as well, usually with no more than 180 days of absence within each twelve months; for special cases of absence, it will be verified according to the corresponding provisions.

Close to five years, how to wrap up ILR?

The current official application guidance allows applications to be submitted as early as 28 days before the five-year qualifying period is completed, but the duration is just one of the conditions. Employers still need to confirm that the job will be needed in the foreseeable future and meet the corresponding salary requirements. According to the current standard category in 2026, the annual salary of £41,700 and the occupation's going rate are usually required simultaneously; positions in healthcare, education, and other sectors with specific provisions are assessed separately. The preferential salary obtained upon graduation cannot be directly used as the salary standard for applying for permanent residency several years later; the future threshold should be rechecked at the time of actual application.

Language and life knowledge requirements should also be included in the plan: Life in the UK must be met or exempted; for work visa settlement applications after March 26, 2027, English will be checked according to B2 listening and speaking requirements in principle.

A timeline suitable for graduates should be able to answer these practical questions: up to which day can the current status cover, on which day can the transfer of sponsorship be submitted, until which renewal can the preferential salary be used, and whether the employer can provide the required confirmation upon the five-year term. Those who already have a qualified English certificate should also confirm according to the rules at that time whether they can continue to use it. If the current permit will end before the time when permanent residency can be applied for, the bridging permit must be arranged in advance; it cannot be assumed that "it is almost been five years" and just continue waiting.
