Why are UK bank accounts frozen? 5 common reasons

The bank will not touch your money for no reason, but the threshold for triggering a freeze is lower than you think:

1️⃣ Suspicious Activity Report (SAR) . According to Part 7 of the Proceeds of Crime Act 2002, once a bank "suspects" an account to be involved in money laundering or proceeds of crime, it must report it to the National Crime Agency (NCA) and freeze it pending a response. This is the most common and most puzzling one.

2️⃣ large amount or abnormal transfer . If you suddenly receive a sum of tens of thousands of pounds (such as house purchase money remitted from your parents in China), or if you frequently make large amounts of money in and out of a short period of time, the risk control system will automatically flag it.

3️⃣ KYC information is expired or does not match . If the address has not been updated, the passport/visa has expired, or the identity information does not match the system records, the bank has the right to "freeze it first and then verify it."

4️⃣ was involved in the fraud chain . Even if you just collect a sum of money for a "friend" and the other party is reported, your account may be implicated and frozen. This kind of "scoring score" and "payment collection" trap has trapped many international students in recent years.

5️⃣ Court Freezing Order (Account Freezing Order) . NCA, HMRC or SFO apply to the Magistrates Court to freeze suspected criminal proceeds for up to two years, which is much more serious than temporary risk control.

Why won’t the bank say anything? The "Rule of Silence" for Account Freezes

What devastated many people the most was not the freeze itself, but the fact that no one explained even if asked. This is not a deliberate attempt by customer service to make things difficult. Section 333A of POCA provides for "tipping off". If the bank discloses to you that a SAR has been submitted, the employee can be jailed for up to 5 years. Therefore, front-line customer service often really "can't tell and don't know."

Key timeline: There is usually a preliminary review period of 7 working days after SAR submission, which can be extended by the NCA for a further 31 days (totaling approximately 42 days). Beyond this window, if law enforcement agencies want to continue freezing, they must go to court to apply for a formal freezing order.

In other words, a large number of "temporary freezes" will automatically lift within 6 weeks. Staying calm and cooperating in providing information is often more effective than getting angry on the phone every day.

After your bank account is frozen, there are three correct steps to appeal.

Step one: Prepare proof of source of funds. This is the core of thawing. Organize the source chain of large sums of money into written materials - pay stubs, house sales contracts, parents' gift instructions, and transfer records. The clearer the source and the more self-defeating it is, the faster it will thaw.

Step two: Make a formal complaint to the bank. does not complain to customer service, but goes through the written complaint process. Banks usually have to respond to complaints involving payment services within 15 working days, with a maximum of 35 days for complex cases; other account-related complaints generally require a maximum of 8 weeks to give a final response. Be sure to record it in writing and keep the number.

Step 3: Upgrade to the Financial Ombudsman Service. If you are not satisfied with the bank's reply or do not reply within the time limit, you can complain to FOS for free. What Ombudsman values ​​is not whether the bank was worried at the time, but whether the freeze was proportional, whether communication was in place, and whether there was any unnecessary delay. Once it is determined that you have suffered losses as a result, the bank can be ordered to compensate you, including compensation for mental and inconvenience.

In the 2023/24 financial year, there were 75 successful challenges to account freezing orders, with a total recovery of approximately £14.5 million. Complaints with solid evidence can win.

When encountering a court freezing order, don’t bear it yourself

If you receive a formal Account Freezing Order, the nature of which involves criminal/civil recovery and cannot be resolved by complaining.
