UK Permanent Residency New Framework Revealed: Who Can Still Obtain It in 5 Years? Here's the New Answer This Time
永居计算器 · November 2, UK New Policy Special / 01
First, review the document status: This article interprets the UK government's response to consultation CP 1707, published on November 2, 2026. It establishes a new framework, but implementation still requires detailed immigration rules and operational guidance. The following "new framework" should not be directly treated as an already effective application requirement.
If you've already lived in the UK for four years, with only one year left until you're eligible to apply for permanent residency according to your original plan, what you probably want to know most is just one question: "Should I wait another five years?"
The UK government's 62-page response released today offers clear policy protections for some, while requiring others to reassess their plans. What's most worth noting is how you qualify for the three-, five-, or ten-year pathways, and whether your previous time can still count.
01|What was actually announced today?
This news can be divided into three time points: the immigration white paper proposing reform directions in May 2025; the consultation document seeking opinions in November 2025; the government's response on November 2, 2026, announcing the final framework following consultations.
The official page has been updated to "Consultation outcome," clearly stating that the next step is to transform the framework into detailed rules and operational arrangements, with further technical guidance and a full impact assessment to be published before implementation. Therefore, "the government has decided to make changes" and "applications submitted today will be calculated under the new rules" must be treated separately.
The overall direction this time: The standard starting point remains 10 years; eligible individuals may follow a 3-year or 5-year pathway; certain violations or specific welfare receipt situations may lead to longer pathways. Years are just one condition—income, English proficiency, conduct, and qualified residence status must also be met simultaneously.
02|Five years still remain, but it depends on what you have to offer
Category 1: High-income applicants who meet the eligibility criteria. The government has responded by setting a five-year income threshold of £50,271 and introducing a look-back years arrangement. This does not mean "you can apply for permanent residency as soon as your salary increases this year"—see detailed calculations in the second article of this issue.
Category Two: Designated public service positions in healthcare and education. Individuals who meet national grade-level requirements and specified occupational criteria may enter the five-year pathway. This should not be interpreted as applying to "all NHS employees" or "all school staff"; one must verify the specific occupation and the list in Appendix C. XX1YY
Category 3: Qualifying UK connections as specified. The response retains the five-year arrangements for eligible UK citizen partners, parents, children, and other specific connections such as UK Ancestry. Marital or familial relationships alone do not substitute for route eligibility and other conditions.
Category IV: Old groups receiving explicit transitional protection. This is precisely the part that is most easily omitted in headlines today, yet deserves the closest reading.
03|Five Years of Protection by the Old Caregiver, with Three Key Words
As stated on pages 38–39: individuals who entered or transitioned onto the care worker route before or during the release of the 2025 Immigration White Paper, if they meet the applicable salary requirement (listed annually at £25,000), sponsorship and employment criteria, will retain their existing five-year qualifying period. The enhanced requirements regarding character, English language proficiency, etc., under the new framework generally still apply, except where specific exemptions are granted.
The three key points are: the time of entry or transition, genuine sponsored employment, and meeting salary requirements. Simply stating "I came to the UK in 2023" is insufficient; if you were on a student visa at that time and only switched to a care worker visa after the white paper was published, your case clearly falls outside this transitional protection.
Another group of healthcare and education positions, paying below RQF6 according to national pay scales—such as qualified care assistants and teaching assistants—also have a one-time five-year transitional arrangement for those who came to the UK before the White Paper was published and meet visa requirements. The specific occupational boundaries still need to be verified individually.
protects a specific group, not all "old immigrants." document clearly states that these arrangements do not establish universal exemptions for everyone already living in the UK. Ordinary skilled worker visa holders cannot assume that their original five-year route has been fully preserved merely because they arrived early.
04|What old approaches were actually changed this time?
below the RQF6 position: The original 15-year pathway has been withdrawn. Under the new framework, the standard pathway is now set at ten years, while retaining the possibility of qualifying earlier under accelerated conditions; specific transitional groups will be considered for protection separately.
Volunteer service for reduced residency period: Not adopted. Government response: No longer using volunteer service to shorten permanent residency requirements. C1 English proficiency for reduced residency period: Also not adopted. English proficiency standards and eligibility for time reduction are separate issues.
family members all individually "earn permanent residency": some adjustments made. government now places greater emphasis on family's joint contributions and shared settlement, allowing eligible partners to combine incomes, while children are handled according to age categories. The second article will clarify the amounts and age thresholds together.
05|Don't mix "BN(O)" and ten years of residence in the same sentence
The five-year provision for BN(O) is retained in the response, but the document also mentions general strengthening requirements, including B2 English and a new criminal record requirement, except where exemptions or protections apply. Therefore, "five-year retention" does not equate to "all requirements remaining completely unchanged." The EUSS is listed as a separate arrangement unaffected by this Earned Settlement reform.
On the other hand, the government has decided to close the independent Long Residence ten-year residency pathway under the new framework, and temporary residence periods will no longer be accumulated in this way. This does not mean your previous student duration is automatically reset today , nor does it mean the government has committed to protecting everyone who is nearly ten years in. Implementation and transition provisions must continue to be verified.
Next, first find your own line
Look at your visa route, entry or changeover date, occupation, income records, and dependents' ages together. Don't just ask "How many years for UK permanent residence?" Instead, ask "Which route should be used to calculate my case?"
Second article this period: £50,271, joint income of spouses, child turning 18—how does it actually affect you?
Third article this period: Students, Graduates, and those nearing ten years—what should you check now?
