Can you leave the country during the permanent residency application period? Your passport may be automatically withdrawn even if it is not detained.

JustiScript•26 August 2026•👁️ 1617

The passport is in your hands, and the flight ticket is already booked. But once that plane takes off, your permanent residency application, which you've been waiting five years for, will automatically become invalid at the moment of departure - no Ministry of the Interior approval is needed, and no one will remind you in advance.

Many people take "whether the passport is detained" as the criterion for whether they can leave. This criterion has completely become invalid by 2026.

After submitting the permanent residency application, will the passport still be withheld?

First, let's wrap up this most frequently asked question. As of October 6, 2021, Part 1 of the Immigration Rules, rule 34J states that identity documents (such as a passport) submitted when applying for permission to stay will generally be returned to the applicant during the processing period, unless the Home Office considers it necessary to retain them. In practice, "necessary retention" often applies to those who have overstayed their visa or are in the UK on a visitor visa.

In addition, now almost all domestic permanent residency applications are submitted online through UKVCAS, or directly using the UK Immigration: ID Check App to scan the passport chip. The documents are digitally submitted, so the passport does not need to be sent out. Therefore, "passport being withheld after submitting the permanent residency application" is no longer the norm today.

Your passport in your hand only means that the Home Office does not need to hold this document, it does not mean that you are allowed to leave the UK. These two things are not mentioned in the same rule in the regulations.

Why does leaving the country automatically withdraw the permanent residency (ILR) application: 34K Clause

Immigration Rules Part 1 paragraph 34K stipulates: If an applicant leaves the Common Travel Area (CTA), which includes the United Kingdom, the Republic of Ireland, the Isle of Man and the Channel Islands, the application for permission to stay is deemed to be withdrawn from the date of departure.

Note the wording: it is "deemed as withdrawal", not "may be withdrawn". This is a legal effect produced by the rule itself, and does not depend on the Ministry of the Interior's active action.

In recent years, the enforcement has been relatively relaxed, and indeed, some people have obtained visas after leaving the country. Therefore, there has always been a rumor on forums that "no one checks." However, in recent years, the Ministry of the Interior has started to issue cancellation notices to some applicants. Moreover, entry and exit records have already been computerized, so the space to bet on "not being found" is shrinking.

How much is the cost? The permanent residency application fee is £3,226 per person starting from April 8, 2026, and it is non-refundable if withdrawn; the premium service fee is also non-refundable even if you leave the country yourself. Permanent residency applications do not charge IHS, so there is no "IHS refund" buffer. If you want to continue, you will have to pay the full amount again and start the queue from scratch.

3C leave, invalid once exit: This exit risk comparison table is recommended to be saved.

Many people overlook the second layer of risk. If you submitted your settlement application before your original visa expired, your lawful status in the UK now relies on 3C leave (Section 3C of the Immigration Act 1971) - the conditions of the old visa are extended until a decision is made. However, 3C leave only exists while you are inside the UK, and it terminates once you leave the country, and will not be restored upon your return.

This means that two people, one whose original visa has not yet expired and the other "relying on 3C", both bought a ticket, but the consequences were completely different:

Your situation What happens after leaving CTA Advice
The original visa remains valid, permanent residency application is pending Permanent residency application is considered withdrawn under 34K, no refund; can still enter with the original visa Non-urgent matters must wait for the next visa before proceeding
The original visa has expired, relying on 3C leave Application withdrawal + 3C termination, no valid entry permit is currently in hand Do not depart, first consult a lawyer
Only go to Ireland / Isle of Man / Channel Islands Not left CTA, 34K not triggered Retain itineraries and tickets for inspection
EUSS (Appendix EU) application is pending According to the current EUSS guidelines, it is generally not considered as withdrawal Must be able to prove the pending status at the border
has received the approved email There has been a decision, no longer subject to 34K constraints First confirm eVisa is associated with the passport

Have to leave due to an urgent family matter, how to handle the permanent residency application to avoid losses?

In cases such as attending a funeral or serious illness where it cannot wait, handle them in this order to minimize losses:

The first step is to confirm whether the destination is within CTA. Going to Dublin does not count as leaving the country, which can save some people.

Step two, see if it can be upgraded to expedited. Domestic Priority and Super Priority service can compress the processing to a few working days, so that you can get the result first and then fly, which is the only way to keep both money and status. The specific price and availability are subject to the current announcement from GOV.UK.

Step 3, if you must leave immediately, follow the formal withdrawal process. GOV.UK offers a dedicated online service "Cancel your application and retrieve your documents" (Get your visa, immigration or citizenship documents back). The rules are straightforward: If you want to retrieve the documents to travel, you must withdraw your application; without withdrawing, you can only retrieve them by citing "proving identity" as the reason. Those who qualify usually receive the documents within about 10 working days. People without a valid residence permit cannot use this online service.

The worst is the fourth type: people who send a message asking "Is it okay for me to go like this" when they are already at the check-in counter. 34K only cares whether you have left CTA, not how solid your reasons are. If unsure, spending £5 on justiscript.com to get a written response from a UK-qualified lawyer within 24 hours is much cheaper than taking a gamble at the airport.

After applying for permanent residency, check these 3 things today

① Find out what status you are currently in the UK: is your original visa still valid, or have you entered 3C leave. This determines whether you have a ticket to return after leaving.

② Keep the screenshot of the submission date, receipt of submission, and confirmation letter for biometric information collection. Once a dispute arises, the chronological order of the "date the decision was made" and the "departure time" is the key fact.

③ Log in to your UKVI account and confirm that the current passport number is correctly linked to eVisa. BRP has been discontinued, and during entry, the immigration officers will verify your electronic identity in your account. If the passport number does not match, it may take several hours at the airport.

By the way, a reminder: after obtaining permanent residency, there is still a red line - if you leave the UK for a full 2 years continuously, ILR will automatically become invalid. The waiting period cannot be left, and after obtaining it, you also cannot stay away for too long. These are two separate rules. Regarding the number of days abroad, using the 永居计算器 app to calculate precisely by visa type is more reliable than counting on your own calendar.

Make a possibly unpopular judgment: During the period of pending permanent residency, any non-life-or-death reason for leaving the country is not worth exchanging £3,226 and five years of residence records for. This is not being conservative, because 34K does not give you a chance to appeal - it doesn't ask about the motive, but only looks at the border records.

The above "Outbound Risk Comparison Table" is most suitable for two groups of people to refer to: those who still hold an unused ticket and are hesitating; and those whose original visa has expired and are currently relying on 3C leave to hold on. Once the latter board the plane, they really won't be able to return.
