Can you leave the country during the permanent residency application period? Even if your passport is not detained, the case may be automatically withdrawn.

JustiScript

The passport is in your hands, and the flight ticket is already booked. But as soon as that plane takes off, your permanent residency application, which you have been waiting for five years, will automatically become invalid at the moment of departure - no Ministry of the Interior approval is needed, and no one will remind you in advance.

Many people take "whether the passport is detained" as the criterion for whether they can leave. This criterion has completely become invalid since 2026.

After submitting the application for permanent residency, will the passport still be withheld?

Get this most frequently asked question out of the way. From October 6, 2021, Part 1 of the Immigration Rules, clause 34J clearly states that identity documents (passport) submitted when applying for permission to stay will be returned to the applicant during the processing period, unless the Home Office considers it necessary to retain them. In practice, "necessary retention" is commonly seen in cases of overstayers or those entering the UK as visitors.

In addition, now almost all domestic permanent residency applications are submitted online through UKVCAS, or directly using the UK Immigration: ID Check App to scan the passport chip. The documents are digitally submitted, so the passport does not need to be sent out. Therefore, "passport being withheld after submitting the permanent residency application" is no longer the norm today.

Your passport in your hand only means that the Home Office does not need to hold this document, it does not mean you are allowed to leave the UK. These two things are not on the same rule in the regulations.

Why does leaving the country automatically withdraw the Permanent Residency (ILR) application: Clause 34K

Immigration Rules Part 1 paragraph 34K stipulates: If an applicant leaves the Common Travel Area (CTA), which includes the United Kingdom, the Republic of Ireland, the Isle of Man and the Channel Islands, the application for permission to stay within the country will be deemed to have been withdrawn from the date of departure.

Note the wording: it is "deemed to be withdrawn," not "may be withdrawn." This is a legal effect produced by the rule itself, and does not depend on the Ministry of the Interior's active action.

In recent years, the enforcement has been relatively relaxed, and indeed, some people have obtained visas after leaving the country, leading to the rumor on forums that "no one checks." However, in recent years, the Ministry of the Interior has started to issue cancellation notices to some applicants. Meanwhile, entry and exit records have already been computerized, so the space to bet on "not being found" is shrinking.

How much is the cost? The permanent residency application fee is £3,226 per person starting from April 8, 2026, and it is non-refundable upon withdrawal; the expedited service fee is also non-refundable even if you leave the country yourself. Permanent residency applications do not charge IHS, so there is no "IHS refund" buffer. If you want to continue, you will have to pay the full amount again and start the queue from the beginning.

3C leave: invalid once you exit the country. This exit risk comparison table is recommended to be saved.

Many people overlook the second layer of risk. If you submitted your settlement application before your original visa expired, your lawful status in the UK now relies on 3C leave (Section 3C of the Immigration Act 1971) - the conditions of the old visa are extended until a decision is made. However, 3C leave only exists while you are physically present in the UK, and it terminates once you leave, and will not be restored upon your return.

This means that two people, one whose original visa has not yet expired and the other "relying on 3C", both bought a ticket, but the consequences are completely different:

Your Situation What Happens After Leaving CTA Advice
The original visa remains valid, permanent residency application is pending Permanent residency application is considered withdrawn under 34K, no refund; the original visa can still be used to enter Non-urgent matters should wait for the next visa before proceeding
The original visa has expired, relying on 3C leave Application withdrawal + 3C termination, no valid entry permit in hand Do not depart, first consult a lawyer
Only to Ireland / Isle of Man / Channel Islands Not left CTA, 34K not triggered Retention of travel itineraries and tickets for inspection
EUSS (Appendix EU) application pending According to the current EUSS guidelines, it is generally not considered as withdrawal Must be able to prove the pending status at the border
has received the approved email has already made a decision, no longer subject to the 34K restriction First confirm that eVisa is associated with the passport

Have to leave due to an urgent family matter, how to handle the permanent residency application to avoid losses?

When it comes to situations like attending a funeral or serious illness where you can't wait, handle it in this order to minimize the loss:

First, confirm whether the destination is within CTA. Going to Dublin does not count as leaving the country, which can save some people here.

Step two, see if it can be upgraded to expedited. Domestic Priority and Super Priority service can compress the processing to a few working days, get the result first then fly, which is the only way to keep both money and status. The specific price and availability are subject to the current announcement of GOV.UK.

Third step, if you must leave immediately, go through the formal withdrawal process. GOV.UK offers a dedicated online service called "Cancel your application and get your visa, immigration or citizenship documents back." The rules are straightforward: If you want to retrieve your documents to travel, you must withdraw your application ; without withdrawing, you can only retrieve them by citing "proving your identity" as the reason. Those who qualify usually receive their documents within about 10 working days. People without a valid residence permit cannot use this online service.

The worst is the fourth type: people who send messages asking "Is it okay for me to go like this?" only after they have already arrived at the check-in counter. 34K only cares whether you have left CTA, not how solid your reasons are. If in doubt, spending £5 on justiscript.com to get a written response from a British-qualified lawyer within 24 hours is much cheaper than taking a gamble at the airport.

Check these 3 things right after submitting your permanent residency application

① Find out what status you are currently in the UK: is your original visa still valid, or have you entered 3C leave. This determines whether you have a ticket to return after leaving.

② Keep the screenshot of the submission date, receipt of submission, and confirmation letter for biometric information collection. Once a dispute arises, the chronological order of the "date the decision was made" and the "departure date" is the key fact.

③ Log in to your UKVI account and confirm that the current passport number is correctly linked to eVisa. BRP has been discontinued, and during entry, the immigration officers will verify your electronic identity in your account. If the passport number does not match, it may take several hours at the airport.

By the way, a reminder: after obtaining permanent residency, there is still a red line - if you stay outside the UK for a full 2 years, ILR will automatically become invalid. The waiting period cannot be skipped, and after obtaining it, you cannot stay away for too long. These are two separate rules. For the number of days spent abroad, it's more reliable to use the 永居计算器 app to calculate precisely by visa type, rather than counting on your own calendar.

Make a possibly unpopular judgment: During the period of pending permanent residency, any non-life-or-death reason for leaving the country is not worth exchanging £3,226 and five years of residence records for. This is not being conservative, because 34K does not give you a chance to appeal - it doesn't ask about the motive, but only looks at the border records.

The above "Exit Risk Comparison Table" is most suitable for two types of people to refer to: those who still hold an unused ticket and are hesitating; and those whose original visa has expired and are currently relying on 3C leave to get by. Once the latter board the plane, they really won't be able to return.

Also want to hear about your experience: After you applied for permanent residency, did you miss anything important because you were afraid to leave the country?
