ILR How long is it safe to stay in the country after obtaining it? 2-year red line and evidence retention

JustiScript•7 September 2026•👁️ 1558

In the UKVI account, the line for ILR looks like this: the status is written as "Indefinite leave to remain", the next column says "No expiry date", and there is a button on the right to generate a share code. The entire page has no countdown, and there are no reminders such as "Please return to the UK before a certain date".

It does not actually expire. What will be completed is something else: the period you spend outside the UK.

Two years start from which day?

The legal source is Article 13(4)(a) of The Immigration (Leave to Enter and Remain) Order 2000 (SI 2000/1161): if the holder has stayed outside the United Kingdom for a continuous period of more than two years, the indefinite leave to remain will immediately expire. The key word is "continuous," meaning consecutive, not accumulated over five years.

This means the timer only recognizes the day of your last departure from the UK. Any real entry in between would reset it, starting again from the new departure date. Theoretically, returning once every year and eleven months would mean this line is never touched.

But I don't recommend setting your red line at two years. I suggest continuous absence not exceeding six months. Two years is just the legal boundary, and it's a hard boundary; even one day over is not allowed. Arranging your life by following this hard boundary could push you over with a single flight cancellation or a surgery. The number of six months comes from another set of requirements, see the next section.

Store these four items a week before returning home

what to store specific file where will it be used in the future
Each entry and exit Boarding pass, booking confirmation (with name, date, flight number) Check absence periods section by section
Residential anchor point in the UK Lease or property documents, council tax, utility bills, at least one per year Provide residential evidence annually
Identity Snapshot Passport Information Page, Old BRP Scan, ILR Approval Letter Replace Passport, Recover Account
Reason for Absence Letter of Assignment, Medical Records of Relatives, Proof of Enrollment in School Explanation for Long-term Absence

The storage method is very primitive: a cloud folder, subfolders by year, and the filename is directly written as "2026-03-14 Leave UK CA938". After three years, no one remembers which flight they took. 📁

Each period exceeding six months must be written out in the future.

The figure of 6 months is not written in the expiry clause, but in the set of documents for the No Time Limit (NTL) application. After BRP leaves on December 31, 2024, residents who hold old documents, have expired passports, or have no electronic evidence need to convert their status to eVisa through NTL. The "No time limit" guidance for caseworkers (version dated April 1, 2026) requires applicants to explain each period of continuous absence exceeding 6 months since obtaining permanent residence and provide evidence of residence in the UK by year; caseworkers also need to determine whether these absences have caused the permanent residence to expire. The original text of the Guidance is written this way. This application itself is free of charge.

So two years is the legal red line, 6 months is the evidence red line . Round trips shorter than six months almost don't need explanation, while each segment longer than six months you will have to reconstruct from memory and documents several years later.

Which section is adjacent to the border, whether it can be clearly determined, if you are unsure, make a table of the start and end dates, pay £5 at justiscript.com for a British practicing lawyer to take a look, which is more convenient than repeatedly guessing.

ILR will not be notified when it becomes invalid

The failure occurs by operation of law: no decision by an adjudicator, no letters, no text messages. The UKVI account will not change either, and upon logging in, you will still see the line "Indefinite leave to remain" and "No expiry date". The real situations where it is encountered are usually at the check-in counter or at the immigration control after landing, and the Border Force has no authority to grant a right to re-enter the UK on-site at the port.

The account shows normally and does not constitute any evidence of "I have not expired yet."

You can request your own entry and exit records for free.

Passport has been replaced, old stamps are incomplete, dates are mixed up, these can all be remedied. According to the Data Protection Act 2018, anyone can submit a subject access request to Home Office to obtain their records in the immigration and border system, which includes entries and exits from the UK. This request is free, and a response is normally expected within one month (it may be extended if the case is complex or additional verification of identity is required); when submitting a passport, it usually covers the last 5 years of entry and exit records.

The recommended sequence of actions is: before planning to return to your home country for long-term residence, make one adjustment first, aligning the official records with your own list, and supplementing any documents for discrepancies on the spot. When you need them several years later, the missing parts you have already failed to make up.

The last thing to mention that was not previously stated: the two-year rule does not apply equally to everyone. The accompanying spouses and children of members of the British armed forces, as well as British citizens permanently employed in Crown service or the British Council, and their accompanying family members, are not counted within these two years (SI 2000/1161, paragraph 13A and related guidance on lapsed leave). This door is open, but narrow enough that most people cannot push it open - the significance of remembering this is not to think that the rules have become more flexible just because you see online that "someone left for three years and it was okay."
