How to apply for BNO permanent residence? How to calculate 5 years, B2 deadline and visa rejection points
Applications for BN(O) visa will be officially opened on January 31, 2021. The first group of families to land in the UK will have been here for five years this year (2026).
The data also confirms this: in the year ending March 2026, a total of 8,682 permanent residence (Settlement) were approved for the BN(O) path, which is significantly higher than in previous years - because the first batch of people have arrived.
But the questions we’ve received recently are almost all focused on the same set of anxieties: Does the five years of still count? When I return to Hong Kong to take care of my parents in 2023, will the five years be cleared? Can the B1 certificate still be used? is dismantled in order.
1. Is BNO permanent residence still for 5 years? The latest caliber in 2026
Still five years.
The "Earned Settlement" plan launched by the Ministry of Home Affairs at the end of last year has increased the base period of permanent residence for most visa categories from 5 years to 10 years. The public consultation has ended on February 12, 2026. However, the plan document is very clear: BN(O) holders and British citizen spouses/dependents who meet the core conditions, retains the 5-year path and is not merged into the 10-year basis.
⚠️ Keep it for 5 years ≠ Nothing will change. The plan also mentions that people taking the five-year path may have to meet new "mandatory conditions" in the future (such as income or contribution thresholds for a certain number of years). At present, these have not yet been written into Immigration Rules. The new rules may be implemented as soon as the autumn of 2026, subject to the announcement of GOV.UK.
A practical suggestion for those who still have a year or two to go: Don’t delay for . Rule changes usually apply to new applications from the effective date. The earlier you meet the conditions and the earlier you submit, the less likely you are to meet the new threshold.
2. How to calculate the 5 years of BNO permanent residence? 180 days are rolling
This is the easiest way to overturn. Continuous residence requirements: During the five-year qualification period, in any rolling 12-month period of , the person must not be absent from the country for more than 180 days.
The focus is on the word "scroll". It is not calculated based on the anniversary of the visa, nor is it calculated based on January to December, but it must be calculated from any day forward 365 days. To give an example of a real accident: I returned to Hong Kong for 100 days in September 2024, and then went back for 95 days in June 2025 - neither trip exceeded the limit, but when they were included in the window from September 2024 to September 2025, the total was 195 days, which was exceeded.
This kind of pitfall of "overlapping new years" is difficult to see in the schedule with the naked eye. If you have multiple entry and exit records, it is recommended to list the complete entry and exit dates of each entry and exit and check them window by window, or use 永居计算器APP to calculate the rolling windows of each day clearly, which is much less troublesome than supplementing materials afterward.
Another bonus that many people don’t know: the other “leading to permanent residence” visa periods before gets the BN(O) visa can be combined into the five years of . Skilled Worker, Global Talent, UK Ancestry, Appendix FM spouse route, etc. all count; however, student visa (Student) and youth mobility visa (YMS) do not count as because they do not lead to permanent residence. So friends who study first and then transfer to BN(O), those years as a student are in vain.
3. Two BNO permanent residence exams: Life in the UK and English B1/B2
Applicants aged 18 to 64 must have both:
📘 Life in the UK Test - 24 questions, computer-based test, valid for life after passing, used once for permanent residence and again for naturalization, no need to retake the test.
🗣️ English proficiency - Current permanent residence requirements are CEFR B1 level (recognized SELT examination, or English-taught degree). According to the currently announced arrangements, starting from March 26, 2027, the English threshold for permanent residence will rise to B2, which is roughly equivalent to the span of A-Level rather than GCSE.
The practical implication of this for BN(O) families is: If you can submit the application before March 2027, the B1 score on hand will be enough; if your five years will not be completed until the second half of 2027, it is best to prepare for B2 now, and don’t wait until you find out you have to retake the exam. Elders who have already obtained B1 should especially plan ahead. The specific list of exemptions and recognized examinations is subject to the latest announcement of GOV.UK.
4. How much is the BNO permanent residence application fee for 2026? How about a family of four?
Fee schedule effective from April 8, 2026: permanent residence (ILR) application fee £3,226 per person , does not have child price, there is no family package, and each accompanying family member must pay the full amount.
In other words, for a family of four, two adults and two children, the government fee alone is and £12,904. Expedited charges: Priority add £500 (target 5 working days), Super Priority add £1,000 (target next working day). The good news is that there is no need to pay the IHS medical surcharge for the permanent residence application. This expense, which usually costs thousands of pounds, ends here.
The normal processing time is up to 6 months. If you are not in a hurry, it is more practical to save the expedited fee.
5. The most common rejection points for BNO permanent residence, and the room for remedy
From a practical point of view, when BN(O)’s permanent residence is rejected or required to provide supplementary documents, the reasons are mostly due to the following reasons:
① The entry and exit date of is reported as . Filling out forms from memory is the most dangerous. Look through passport stamps, air tickets and emails, and bank card overseas consumption records, and nail down the dates before filling them in.
② The five-year starting point of is wrong as . It is calculated based on your actual residence after you arrived in the UK on and activated your visa on , not based on the visa approval date or application date.
③ was overdue and did not proactively indicate . If it really exceeds 180 days due to serious illness, bereavement of an immediate family member, force majeure, etc., Home Office's guidelines leave room for discretion, but only if you take the initiative to explain in writing and attach evidence (medical certificate, death certificate, flight cancellation record). If it is hidden and discovered, its nature will change.
④ ignores suitability. A criminal conviction, serious traffic penalties, tax arrears, or a history of providing false information on an application may alone be grounds for denial.
If your situation is stuck in a gray area - such as more than 190 days, or there was a visa gap in the middle - it is not recommended to guess by yourself. Spending £5 on justiscript.com will allow a practicing British lawyer to provide a written response to a specific question within 24 hours, in both Chinese and English. Spending a few pounds to confirm the direction first is more cost-effective than betting on an application fee of more than 3,000 pounds.
Finally, I would like to remind you something that many people forget: after you get your permanent residence, you can live there for for 12 months before you can apply for naturalization - this is what is often called "5+1". Permanent residence is not the end, it is the beginning of the countdown.
