What should I do if I’ve forgotten to renew my visa before it expires? The UK’s 14-day grace period

JustiScript

The most frequently asked question is: ‘My visa expired the day before yesterday, and I’ve only just realised it today – can I still apply for a renewal?’

You can submit it, but you must do so today, and work must stop today.

From the day following the expiry date, two things will happen simultaneously

The first point concerns status. Section 3C of the Immigration Act 1971 only comes into effect under one condition: that an application for an on-shore extension was submitted by prior to the expiry of the original permit on . If the application is submitted after the expiry date, Section 3C never takes effect; the guidance on ‘3C and 3D leave’ (Home Office) states this quite clearly. Therefore, from the day after the expiry date, the individual’s status is that of an overstayer, with no automatic extension.

The second is the condition. All conditions attached to the original permit terminate along with the permit. The work right already ends on the day after the expiration, not when the new application is rejected. The statutory excuse on the employer's side also becomes invalid on the same day. Continuing to schedule shifts for employees and the company is a risk. This point is often overlooked in practice much more frequently than the status itself: the person is still sitting in the office, but the validity period in the Right to Work file has already passed.

The two actions that can be done on the same day are very specific: inform the employer to process it as no work permit, and suspend attendance; submit and pay for the domestic application on the same day.

What exactly is the 14-day grace period for?

This rule was previously numbered paragraph 39E, HC 1333. It has been deleted from 39E and the entire Part 9 has been revoked as of November 11, 2025. Now it is numbered SUI 13.1 in Part Suitability. The provision requires both conditions to be met: the application must be submitted within 14 days after the original license expires; and the application or with the application, a legitimate reason that is beyond the control of the applicant or their agent is provided, explaining why the application could not be submitted on time.

SUI 13.1 does not extend the license. Within 14 days, you are still in an expired state, your work rights are still not granted, and 3C will still not be generated. It deals with how the subsequent application is treated during review for this expired period, rather than giving this 14-day period a legal status.

The "reason" item is discretionary, while the "date" item is strict. The current "Applications from Overstayers" case handling guidance (8th August 2026 edition) clearly states that merely forgetting to apply on time does not constitute a valid reason beyond control; the same document also leaves a channel: if the applicant is unable to apply due to serious illness or medical condition, and the condition has lasted more than 14 days, the case officer may exercise discretion in exceptional or compassionate circumstances. The original text of the Guidance is written this way, so the evidence direction is clear - things that can be evidenced, such as emergency and hospital records, proof of death of a close relative, rather than not receiving a reminder or system failure.

My judgment is: don't wait a few more days just to come up with a decent reason. The wording is "in or with the application," the reason can be provided along with the application. Once the date passes the 14th day, there's no turning back. Submit first and upload all existing evidence together.

Persons who have exceeded 14 days should first refer to another set of provisions.

After SUI 13.1 is not applicable, the application is usually stopped at the suitability stage, and the application fee and IHS will not be refunded due to visa refusal. At this time, you should read the section on previous breach in Part Suitability: if you left the UK voluntarily and stayed beyond the allowed period for no more than 30 days (the period of overstay started on or after April 6, 2017), this overstay will not be considered as a breach of UK immigration law; once it is considered a breach and you leave the UK voluntarily, it usually results in a 12-month entry ban.

So the timeline should be arranged according to "Day 30 of the overdue period," not according to the next weekend when you have time to organize the documents. If you are unsure which side you are on, justiscript.com offers a £5 service where a UK-qualified lawyer can provide a written response within 24 hours on a specific issue, which is more convenient than confirming dates in a group chat.

People who have lived continuously for ten years need to count an additional layer: Appendix Long Residence LR 11.1 requires that permission be held every day during the qualifying period. This period of overstay, even if ignored in subsequent applications, will not be counted as days with permission.

Finally, add a fact that was not mentioned earlier

Reading above seems like after the deadline, only passive waiting remains. However, the system has opened a new channel: the guidance "Applications from overstayers" clearly states that starting from July 20, 2026, applicants in immigration bail who are eligible for SUI 13.1 must have their applications reviewed based on substantive conditions, including those that were rejected or returned after being submitted on time, and then re-submitted within the time limit. The accompanying rule changes have made similar adjustments to bail restrictions on almost all routes.

There is indeed a way, but it is only available to those who have a justifiable reason and take action before the 14th day.📌 It's worth putting the visa expiration date and the next possible application date into your calendar now, rather than relying on memory.
