How long after obtaining BNO British permanent residency can one apply for citizenship? How is the 6 years calculated?

JustiScript

A permanent residency approval notice, listing the name, application number, and approval date. Next to it is a calendar, which can be used to note down the date of permanent residency approval and the planned naturalization application date. The subsequent calculations will start from these two fields.

The five-year period moves with the filing date.

According to the current UK government's BN(O) naturalization guidelines, those who have BN(O) status and apply through the usual residence route usually need to wait for one more year after obtaining permanent residency. This is where the "five plus one" comes from. If we look at the current British Nationality Act 1981 (British Nationality Act) section 4(2), the five-year residency period and the twelve-month period without a residence requirement are both conditions that are checked simultaneously. The regulation checks the five years prior to the submission of the naturalization application, and this window moves with the submission date. The time spent residing after obtaining permanent residency is also included. Therefore, six years is just a common estimate of the time required, and it cannot be directly replaced by adding six years to the first approval date.

This article mainly discusses the registration and naturalization of adult holders of BN(O); only the adult family members of this visa route, as well as minor children, need to confirm the applicable channel separately.

ILR is usually approved after one year

The provision further requires that the applicant has usually not been subject to the residency time limit in the twelve months prior to the application. For those who obtained ILR through the BN(O) route, this period usually starts from the actual approval of permanent residency. The time taken to submit the permanent residency application and wait for processing does not automatically count as time holding permanent residency. As a simple arithmetic example: if it takes two more months after five years to be approved, according to the usual twelve-month requirement, the naturalization application date would come around six years and two months. Even if the sixth anniversary of entry has arrived, the twelve months after approval may still not have been completed; other naturalization conditions must also be met on the proposed submission date.

When verifying, you can copy the approved date from the approval notice into your calendar and keep the notice as evidence; the previously estimated date of obtaining permanent residency will not replace the actual approval date.

These two requirements have different discretionary spaces.

Section 4(4) of the same nationality law allows for some discretion in exceptional circumstances. Home Office "Guidance on Applications by 'Other British Nationals'" clearly defines the boundaries: on the application day, the applicant must not be subject to any residence time limit, and there is no discretion for this requirement; however, there is some flexibility in handling the requirements within the previous twelve months under exceptional circumstances. For those who rely on the BN(O) route to obtain permanent residency, they usually need to first obtain permanent residency before considering whether there is a basis for shortening the waiting period. Being able to submit a request does not guarantee that the request will be approved; the documents need to explain the specific exceptional circumstances.

"Having lived there for six years" alone is insufficient to prove that the special circumstances apply; if preparing to request discretion, it is advisable to first confirm the basis and supporting documents, then determine the payment submission date.

Spouse is already a citizen, can be calculated separately

If the spouse or civil partner was already a British citizen at the time of submission, an alternative assessment can be made under the current "British Nationality Act 1981" section 6(2) naturalisation route. The UK government's spouse naturalisation guidance clearly states that after obtaining permanent residency, there is no need to reside for an additional twelve months. This route still requires the applicant to have lived in the UK for three years prior to applying, and to meet the relevant residence, absence, English language, Life in the UK, and character requirements, with exceptions considered separately. Holders of BN(O) status who choose this route must also prepare the required documents according to the naturalisation requirements, including proof of marriage or civil partnership, as well as proof of the other party's British citizenship.

The spouse only has BN(O) status or ILR, which is not equivalent to having become a British citizen; while waiting for the naturalization decision, it cannot be pre-arranged as if already naturalized.

Six years is the application eligibility.

My judgment is that when there is no applicable British spouse route or special circumstances, should be scheduled by adding twelve months to the actual date of permanent residency approval, and it is not advisable to only pay based on the six-year entry period. When preparing, you can record the expected submission date, the date of permanent residency approval, and the current status of the spouse on the same page, attaching corresponding proofs for each, and then check other conditions of the selected route. Home Office "Guide B2" lists subsequent processes including approval and citizenship ceremony, and a British citizen passport also needs to be applied for separately. "Six years" corresponds to common eligibility milestones and cannot be directly written as the date when the passport is obtained.

Which period do you need to clarify now: the twelve months after the permanent residency approval, or the time when the spouse becomes a British citizen? Welcome to discuss this milestone in the comments section.
