Can the spouse's permanent residency be used if the income is insufficient? Can savings be used?
Home Office "Spouse Permanent Residency Application Guide" states: "You must prove your income."
As of September 28, 2026, the five-year settlement route under Spouse Visa (spouse visa) still has financial requirements. If income has not yet reached the threshold, it may be verified whether eligible deposits can make up the difference. This article checks the applicable tier, fund calculation method, and evidence according to the actual preparation order. Directly using the deposit figures from the renewal may result in higher requirements. The following applies to the Appendix FM five-year partner route; other routes require separate verification of conditions.
It is easier to find the applicable conditions starting from the approval letter.
Spouse ILR first approves the route and income level
First, retrieve the most recent approval letter to confirm it is under the five-year partner route, and then verify whether the qualifying period of residence under the same partner relationship has reached 60 months. The time of the unmarried couple visa does not count towards this qualification period, and the marriage anniversary cannot replace the start date of residence. The basis is the current Immigration Rules Appendix FM E-ILRP.1.3 and 1.4.
After confirming the route, look at the initial application date and the approval result together.
Step two, determine the applicable household income threshold. For applications submitted by unmarried couples or partners, and successfully approved, current license, and same partner, etc., which meet the transitional arrangements before April 11, 2024, the basic threshold remains £18,600 annual pre-tax income; usually £29,000 for those not applicable to the transitional arrangements. For old cases, it is also necessary to check whether dependent children need to be included: add £3,800 for the first child, and £2,400 for each subsequent child, with a maximum of £29,000. Children who are British or Irish nationals, settled or holding a resident permit are usually not subject to this addition. When compiling, include the category of the child's nationality in the calculation table, and do not just multiply by the number of children. Relevant references are Appendix FM E-LTRP.3.5 to 3.8.
Families with partners who receive designated disability or care benefits must be assessed based on sufficient living and housing security standards, taking into account income and housing costs.
In this step of deposit, you can multiply by one less number.
Step three, separate the income that meets the rules from the cash deposits. There is a specific instruction in Appendix FM E-ILRP.1.3(1A) of the Immigration Rules: when calculating the settlement deposit, ignore "2.5 times". When renewing, the amount of eligible deposits exceeding £16,000 should be divided by 2.5 to determine the amount available to cover the income gap; at the settlement stage, the amount exceeding £16,000 can be fully counted.
Income has a shortfall and allows for consolidation with deposits: The required qualifying deposit for permanent residency = £16,000 + annual income shortfall.
Using the hypothetical calculation: with a £18,600 threshold, no children addition, and relying entirely on cash deposits, the required amount for settlement is £34,600; the required amount for renewal under the same threshold is £62,500. If calculated based on a £29,000 threshold, the required amount to meet financial conditions entirely with deposits is £45,000. Even if the amount meets the requirement, the residency duration must still be met separately; you cannot apply early just based on account balance.
Cash deposits cannot be combined with self-employment income, and related income of directors or employees of a UK designated limited company is also subject to this restriction.
Step four, verify the evidence of funds. According to paragraphs 11 and 11A of Appendix FM-SE of the Immigration Rules, regular cash deposits usually need to be held for at least six months continuously before the application, and be in the name of the applicant, partner or both, and under their control, with bank records and source statements provided. The account must allow immediate withdrawal, and early withdrawal may incur a penalty, but it does not automatically disqualify. There are specific holding period conditions for selling a house or converting investments, which should be checked one by one. When organizing, list the required amount, holding period and source documents together, avoiding only looking at the balance on the day of submission.
Money borrowed temporarily cannot be considered as such cash deposits.
Step five, after the financial review is completed, merge the relationship evidence and submission time. Home Office The Family Permanent Resident Case Guide lists common life evidence such as local tax bills, lease agreements, and bank statements; it should cover the relevant period after the last approval, to prove the continuity of the relationship and the shared living arrangement. Accommodation, English, and other statutory conditions still need to be met separately. For a regular five-year spouse application, the earliest submission can be 28 days before meeting the residency requirement; if the current permit expires first, renewal needs to be arranged, and meeting the deposit requirements will not extend the existing permit.
My judgment is that families who meet the criteria and have all other conditions fulfilled are not worth delaying their permanent residency application just to meet the salary threshold. After the financial evidence is verified, they can submit their application according to their qualified date.
