How many years does it take to stay in the UK permanently? Comparison table of visas for 3 years, 5 years and 10 years
The most frequently asked question backstage is always this: "How many more years do I have to endure?"
Some people have been working in London for seven years and thought they should be qualified long ago, but after checking, they found out that the job was cut off due to a change of visa in the middle; some people took the Global Talent and looked confused, not knowing whether they were in the 3-year or 5-year category, and they waited two more years in vain.
There is no uniform number of years for permanent residence in the UK (Indefinite Leave to Remain, referred to as ILR). The number of years of will vary from to your visa category. Today, I will lay out the timetable of the mainstream path once and for all, and by the way, let me tell you where the reform that has not yet been implemented in 2026 has gone.
When does the period of permanent residence in the UK start?
Let me correct a common misunderstanding first: is not calculated from the day you first set foot on British soil, nor is it calculated from the date of the visa approval letter.
The general rule is to calculate from the effective date of of the eligible visa (or the date of entry, whichever is later) , and continue counting all the way to the day you submit your permanent residence application. Mainstream routes such as Skilled Worker allow you to submit 28 days before for five years - these 28 days are a small benefit that many people ignore, and can allow you to get out of the visa cycle nearly a month earlier.
For example: if the visa takes effect on September 1, 2021, and you don’t land until September 20, the starting point is September 20; theoretically, it can be submitted on August 23, 2026 according to the 28-day advance rule. The difference of 20 days is the difference of one renewal fee.
What visas can get permanent residence in the UK in 3 years?
🚀 Global Talent (Global Talent Visa) - but note that it is grouped internally:
Those who are endorsed by Exceptional Talent (outstanding talents), no matter which field, can apply for permanent residence in 3 years; those who are endorsed by Exceptional Promise (potential talents), if they come from the fields of science, engineering, medicine, and humanities, are also 3 years; but among potential talents in the fields of digital technology (Tech Nation category) and art and culture, it is 5 years.
I have seen more than one engineer who wrote Exceptional Talent in black and white on the endorsement letter, but prepared materials based on 5 years. Pull out your endorsement letter and read that line clearly, you may save two years directly.
🏢 Innovator Founder (Innovation and Entrepreneurship Visa) : If the business results conditions are met, it is also 3 years.
In addition, the old Tier 1 series (such as investment category) has 2-year and 3-year acceleration files, but new applications have been stopped for this category, and only existing applicants are applicable.
5-year permanent residence: the path taken by the vast majority of Chinese in the UK
This is the most mainstream one, including:
· Skilled Worker / Health and Care Worker (including old Tier 2): 5 years
· Spouse/Partner visa 5 year path (SET(M)): 5 years
· BN(O) Visa : 5 years
· UK Ancestry (ancestry visa) : 5 Year
·Refugee Status/Humanitarian Protection: 5 years
The most important thing about this category is not the number of years, but the number of days out of the country . The 5-year work path is subject to the red line of "no more than 180 days of departure within any rolling 12-month period" - note that it is a rolling window of and , not divided by visa year. You go out for 100 days in February, and another 100 days in January of the following year, and any 12-month period in between will explode.
The 5-year partner visa route does not apply to this 180-day hard cap, but it is still necessary to prove that the relationship between the two parties is genuine and that the UK is their home. Don't mix the two sets of rules.
10 years of permanent residence: how to calculate the long-term residence path
If you do not belong to any fast track, but have lived legally in the UK for for 10 consecutive years (study permit, work permit, dependent visa, or even a mixture of them can be accumulated), you can take the long-term residence path. The current rules are found at Immigration Rules Appendix Long Residence, which replaces the old paragraph 276B from 11 April 2024.
This path is especially friendly to international students: 3 years for undergraduate + 1 year for master’s degree + 2 years for graduate visa + 4 years for work visa, which makes up exactly ten years. But the word "continuous" is very strict - as long as there is one day without legal status (such as late submission of renewal, overstay), the entire clock may be reset to and recalculated to .
There is also a 10-year pathway for partner visas for those who do not meet the financial requirements and are approved on human rights grounds (Article 8). It is also a "spouse visa". The benefits for 5 years and 10 years are very different. The approval letter will indicate which visa you are on.
Will UK permanent residence be changed to 10 years in 2026? Latest developments
This is the most worrying issue right now. The core of the "earned settlement" concept proposed by the Ministry of the Interior is to extend the standard qualification period from 5 years to 10 years, and then make additions and subtractions based on factors such as income level, tax record, English proficiency, and dependence on public welfare.
The current timeline is this: the public consultation ended on on February 12, 2026, and more than 200,000 responses were received; as of today (August 13, 2026), the government’s official response has not yet been released, and the relevant immigration rules have not yet been submitted to Parliament.
In other words – the current 3-year/5-year/10-year rules are all still in effect today. Retroactivity and transitional arrangements are the most controversial parts among the parties, and the final version is subject to Statement of Changes officially passed by Parliament.
My suggestion is very straightforward: don’t gamble on the policy, submit it as early as possible. The general practice of immigration rules is to review the application according to the rules in effect on the day of submission. The earlier you join the team, the smaller the risk of being exposed to new rules.
After calculating the number of years, there are still three things to prepare simultaneously
The number of years is just the ticket. Almost all permanent residence paths must meet the following requirements at the same time: Life in the UK Test passed, English level B1 (degree or partial nationality is exempt), and no serious criminal or immigration violation records.
💷 In terms of fees, the permanent residence application fee will be and £3,226 per person from April 8, 2026, which is nearly 10,000 pounds for a family of three. There is no discount for children, and in principle, no fee waiver is provided. Please refer to the latest announcement of GOV.UK and be sure to check again before taking action.
