Can the British Police Stop&Search you? your legal rights
On your way home from get off work, two police officers suddenly stop you and ask for a body search. My heart beat faster - what did I do? Can you refuse? Will I be arrested if I don't cooperate? This is a scene that many Chinese people in the UK have actually encountered. Today I will explain clearly the Stop and Search powers of the British police and your legal rights, so don’t panic at critical moments.
Two legal bases for British police Stop&Search
British police searches are not "searches you want". In most cases, there must be clear legal authorization. The most common are two:
① Section 1 PACE (Police and Criminal Evidence Act 1984) : This is the most common basis. The police must have "reasonable grounds" (reasonable grounds) that you are carrying prohibited items - such as controlled knives, offensive weapons, drugs, stolen goods or burglary tools - before they can search you.
Key point: According to the current PACE Code A, the so-called "reasonable suspicion" must be based on objective facts and cannot be based solely on your race, color, age, appearance, religion or past records. In other words, "looking like a foreigner" is never a legitimate excuse.
② Section 60 CJPOA (Criminal Justice and Public Order Act 1994) : This article is quite special. When serious violence occurs or is expected to occur in an area, senior police officers (superintendent and above) can authorize searches of any person or vehicle within the designated area without individual reasonable suspicion, specifically to search for weapons. Authorization is limited to an initial maximum of 24 hours and can be extended to a maximum of 48 hours.
The difference in one sentence: Section 1 requires "reasonable suspicion against you"; Section 60 requires "authorization of the entire area", and you may be searched if you happen to be within the area.
What the police must tell you when you are stopped and searched
The search was not conducted in silence. According to regulations, before searching you, police must proactively inform of the following information (the industry uses the formula GOWISELY to summarize):
🔹 Grounds for the search - why you are suspected;
🔹 What object are you looking for? ; Legal Powers , and you have the right to request search records .
If you are wearing plain clothes, you can ask for police ID (warrant card) . These are your legal rights, and asking clearly does not count as "uncooperation."
How much can I take off for a search in public? Many people don’t know this
Many people are worried about being asked to take off their clothes in the street, but there is actually a clear bottom line. In public places, the police can usually only ask you to take off your coat, jacket and gloves.
If you need to take off more (such as tops and hats in some cases), you must move to a place that is not visible to the public (such as in a police car or a nearby hidden place), and the police officer who conducts the search must be of the same gender as you. This is especially important for female readers - it is against procedure to be asked to strip down to your inner layers in the street without a police officer of the same gender being present.
Can you refuse Stop&Search? What to do after being searched
Let’s be honest: If the police do have legal authority (reasonable suspicion or Section 60 authorization), you cannot resist a search, and forcible obstruction may constitute obstruction of law enforcement. But you can do these things to protect yourself:
✅ remained calm and cooperative, but asked for the above information throughout the entire process;
✅ requested the search record (record/receipt) . If you do not get it on the spot, you have the right to apply for a copy from the police station later (usually within 3 months);
✅ Write down the police number, time, and location, and politely videotape it if necessary (video recording in public places is legal);
✅ If you feel that the search is unfair or discriminatory, you can complain to the police force or IOPC (Independent Police Conduct Supervision Bureau) afterwards.
Special reminder to visa and permanent residents: Simply being Stop and Searched by does not mean that you have a criminal record, and it will not affect your visa or ILR application for . What can really affect your immigration application is being arrested, prosecuted or even convicted. So the more you cooperate, stay calm and keep good records, the better you can protect yourself.
