Can children with a UK visa go to public schools? New Admissions Regulations for 2026

Recently, the same question came up on the backend: if my child has a Skilled Worker family visa, will the school be stuck in admissions because he is "not a British citizen"? Some parents are even more anxious - if applies for free school meals for their children, will it damage the visa conditions and affect future permanent residence applications?

It just so happens that there are new trends in British school enrollment and school meal policies in 2026. Today, I will explain them clearly from a legal perspective.

Will UK visa status affect my child’s enrollment in school?

Let me start with the conclusion, which is also the most important one: immigration status is not an admissions requirement for British public schools .

Under current GOV.UK guidance, any child of compulsory education age (5–16 years) living in England, regardless of nationality and visa type, is entitled to apply for a state school place. The admissions agency (school or local authority) cannot refuse to apply for on the grounds that the child or parent is a foreigner, nor can it require you to produce a visa or immigration document as a prerequisite before granting a degree.

Education law and immigration law are two separate systems. The school is responsible for awarding degrees, and the Immigration Bureau is responsible for managing identity - the school has no obligation or authority to check your visa for the Ministry of Interior.

Specifically for families with work visas: Skilled Worker dependents and children have the unconditional right to attend public primary and secondary schools in England, Wales, Scotland and Northern Ireland. The same applies to accompanying children with spouse visas and student visas.

What UK visa conditions restrict children from attending school?

"The school doesn't check your identity" does not mean "you don't need to check your identity". GOV.UK clearly wrote: It is the parents' own responsibility to check whether their children's entry conditions allow them to study in the UK .

Most family visas (work visa, spouse visa, accompanying children with study visa) allow full-time study by default, so there is generally no need to worry. What you really need to pay attention to is the short-term status. For example, bringing your children to the UK as a visitor (Standard Visitor) is not allowed to study in public schools for a long time. Before changing your status with your child and staying for a long time, be sure to read clearly the study terms under your visa.

Another point that is easily overlooked: dependent children over 16 years old usually need to live with the main applicant (except for boarding schools, colleges, and universities), and must not be married or have children, otherwise it may affect the subsequent renewal of the visa and even the permanent residence timeline of the whole family.

Are free school meals a public benefit? Will it affect permanent residence?

This is the most tangled place for Chinese families. Many work visas and spouse visas carry "No Recourse to Public Funds" (NRPF, not allowed to receive public benefits) conditions. Once you receive benefits in violation of regulations, red lights will appear for renewal and ILR.

The good news is: Free School Meals are not considered "public benefits" under immigration law. DfE has permanently extended school meal eligibility to NRPF families. Work permit, spouse visa, and study permit holders may be eligible to apply as long as their income is below the locally set threshold, and will not touch the NRPF red line.

Moreover, from September 2026, all children of families receiving Universal Credit in England will be eligible for free school meals, further expanding coverage. Please be reminded that although school meals are safe, cash benefits such as Child Benefit and Universal Credit are still restricted by the NRPF, so don’t confuse them.
