5 Common Reasons for Rejection of Permanent Residency: How to Rectify Within 14 Days

JustiScript•25 September 2026•👁️ 888

The rejection letter is usually an email attachment, a PDF, four to six pages. The first page contains the applicant's name, application category, and decision outcome; the middle part consists of numbered paragraphs, each followed by a rule number; the last page has a section titled Administrative review, with two lines below indicating the deadline and fee. The font size is not large, and the layout is very flat.

The information that decides how to proceed is mostly in the next two pages.

Read three things in the visa rejection letter first

The first is the referenced rule number. It determines whether you fall under "the condition itself was not met" or "there was an error in the adjudication process," which are two completely different subsequent paths. The second is whether you have the eligibility for an Administrative Review: within the country, the decision is usually submitted within 14 calendar days, and outside the country within 28 calendar days, with a fee of £80, based on Home Office "Administrative review" adjudication guidelines and Appendix AR of the immigration rules. The third one is the most easily skipped, which is the expiry date of your original permit — it determines when all the windows start from.

Administrative review examines whether the Ministry of the Interior has made a case working error, not re-examining the case.

永居被拒最集中的两类:出境天数和身份空档

The first category is absence exceeding the limit. For applications such as work permits that are subject to Appendix Continuous Residence, absences starting from April 11, 2024, will be calculated on a rolling 12-month basis, with a maximum limit of 180 days. The remedy for this category is not to write an explanation letter, but to use the re-calculation window: enter each trip day by day, find the first date when the total falls within 180 days, and if the current permit is still valid enough, reschedule the submission date to after that day. Daily records are much more reliable than passport stamps, and using 永居计算器 APP to calculate precisely to the day serves the same purpose.

The second type is when the chain of status is broken. For the ten-year residency requirement, you must hold a permission for every single day during the qualifying period; the five-year work visa route also fears gaps. Common break points are when the previous renewal was denied, and the section 3C extension period ends, the person has already lost their permit, yet still applied for permanent residency as originally planned.

The money has been paid, but it may not count as submitting the application.

The third category is applications that are declared invalid and returned. Returning and refusal are two different things: returning does not grant the right to appeal, nor is it counted as a refusal record. However, section 3C has never existed. Once the original permit expires, the person falls into overstaying. This aspect is quieter than "refusal" and is more likely to be misread as "the Home Office is still processing."

There is a change in the location of the provision worth remembering. Previously, the 14-day grace period always referred to paragraph 39E, HC 1333 submitted on October 14, 2025, and on November 11, 2025, 39E and 39F were deleted and Part 9 was revoked altogether. The same set of exceptions were moved into Part Suitability, now numbered SUI 13.1. The content of the provision has basically not changed, but the reference location has changed. Looking up with the old number will not find it. The accompanying Home Office "Applications from overstayers" case guidance, version dated August 3, 2026, lists examples of "justifiable reasons beyond the applicant's control": emergency hospitalization, death of a close relative, delayed school notification CAS. Each item requires evidence, and mere statements are not sufficient.

The three columns of salary, exams, and conduct are filled in completely differently.

The fourth category is slightly worse in terms of hard conditions. The salary for Skilled Worker settlement is assessed at the time of application (SW 24.2). There are four tiers for the cash floor, with the highest tier being £41,700. It's not possible to explain away, so it can only be supplemented to meet the standard before submitting. Life in the UK and B1 listening and speaking belong to the same nature: if one item is missing, it needs to be retaken, and the time cost is manageable.

The fifth category is conduct and declaration. There are declaration obligations for convictions, previous visa refusals, and revoked permits. Omitting them will be treated as false statements, and the nature will jump from "insufficient documents" to "credibility," with completely different consequences. Before making any supplementary documents, the first thing to do is to determine the nature: whether it is considered an oversight or fraud. When in doubt, it is more cost-effective to pay £5 on justiscript.com for a written response from a British practicing lawyer on this specific issue, rather than repeatedly guessing the regulations yourself.

Reason for Refusal Can it be supplemented Next Step
Absent for more than 180 days Yes, based on time Recalculate the rolling 12 months, postponed submission date
Identity has gaps Part can Verify if 3C exists, check SUI 13.1 window
is declared invalid and returned does not go through the review confirms the permit status and correction period on the same day
Salary or exam not meeting the standards can supplement to reach the standard again, re-examination cannot help
Conduct or declaration issues See the determination First determine the nature, then decide what to proceed with

14 Days After Refusal: Submit Again or Request a Review ILR

My judgment is that these 14 days should be prioritized to preserve the identity chain, rather than trying to convince the Ministry of the Interior to change its mind. Categorize into three scenarios -- if the grounds for rejection point to errors in the case review, and relevant evidence was already in the file at the time of the decision, then apply for administrative reconsideration; if the reasons are hard conditions such as time, salary, or KoLL, administrative reconsideration will have little effect, it's more practical to submit a feasible application (often a renewal rather than permanent residency) within the window; only when there is no more reconsideration eligibility, then other avenues can be discussed.

The order cannot be reversed. The case guidance lists "submitting a new application" as one of the situations that terminate the administrative review pending status, which means that once the review is submitted, if a new application is submitted, the review will end immediately. Additionally, there are strict conditions for submitting a second review: only if the result of this review provides new or additional reasons for denial will a new review qualification be generated; the same set of reasons will not be reviewed twice.

Under circumstances where there is no right of review and no appeal, there is still this path of reconsideration request: GOV.UK has a dedicated page, which is free, but it is not included in the immigration rules, and the Home Department has no obligation to accept it, nor will it result in 3C. It is more like a last resort remedy, and should not be considered as the main solution.

Another point needs to be adjusted a bit. It has been talking about the "14-day countdown" above, but a visa refusal does not cancel your existing valid permit. If you applied before the original permit expired, and on the day of refusal, the original permit still had some time left, you would return to that remaining period, legally staying in the UK, with your right to work unchanged. Section 3C only takes over when the original permit has already expired. The urgency is written on your permit expiry date, not on that letter. First, clarify this date, then decide whether to spend the £80.
