What should I do if my spouse’s visa is refused? 4 ways to relieve yourself if your guaranteed income is insufficient

JustiScript6 July 2026👁️ 724

I received a rejection letter from Home Office in the early morning. The reason column contained a line of cold English: does not meet the financial requirement. The sponsor's salary is a few hundred pounds short, or a pay slip is missing - the entire family reunification plan is stuck here.

This is the most frequent reason why Chinese spouse visa (spouse visa / Appendix FM) is rejected. The good news is: being rejected by is not the end. The following four relief routes are assigned according to the situation.

First understand: How much is the guaranteed income for a spouse visa?

Currently (from 11 April 2024) the minimum income threshold for first-time application for a partner visa is £29,000/year . If you held a partner visa before April 11, 2024 and renew it now, the calculation will still be based on the old standard of and £18,600. It is also possible to replace income with deposits (cash deposits for 6 months), and the threshold for the deposit-only route is approximately £88,500 - the exact amount is subject to the latest announcement from GOV.UK.

⚠️ Many people don’t have “really not enough income” but “failed to collect the evidence”: salary slips are missing months, bank statements are out of date, the settlement date is more than 28 days after submission, and self-employment income is not fully documented. This type of visa refusal is actually the most helpful.

Relief Road 1: Administrative Review (Administrative Review)

If you are convinced that your already meets the standard, but the visa officer made a mistake or missed the materials , choose administrative review. It costs around £80 and results are usually available within 28–56 days.

But it has a flaw: cannot submit new evidence , and only allows the official to review the submitted materials for "case working errors". Therefore, it is only suitable for the scenario where "the official made a mistake" and is not suitable for the scenario where "my material was originally leaked".

Remedy 2: Human Rights Appeal (Article 8 Appeal) to the Independent Tribunal

Refusal of a spouse visa usually brings a right of appeal based on Article 8 of the European Convention on Human Rights (right to family life) to the independent First-tier Tribunal. For overseas applications, it usually takes to submit the appeal within 28 days; for those in the UK, it takes 14 days and .

The biggest advantage of the appeal: The judge can consider the updated financial evidence - the salary increase, promotion, and supplementary salary slip obtained after submission may reverse the outcome. The success rate of such appeals involving family life is relatively high (industry data is about 40%), which also shows that many visa rejections are inherently flawed. The price is time: most cases in 2026 will take 6–12 months from submission to outcome.

Remedy 3: Exceptional Circumstances

If your income is really low, don’t give up in a hurry. Appendix FM contains GEN.3.1 / GEN.3.2 exceptions : When visa refusal will bring "unjustifiably harsh consequences" to you, your partner or your children, the official or judge needs to evaluate whether there are other reliable sources of income (third-party long-term funding, partner's expected income, etc.) that can "adequate maintenance" beyond the standard threshold.

This road is particularly important for families with British children and with special health or care circumstances - it is a humane exit beyond the "hard threshold".

Relief Route 4: Complete the evidence and reapply

If the rejection is purely due to insufficient materials and the income is actually up to standard, reapplying is often faster and less troublesome than appealing. This time, just payslips, continuous uninterrupted bank statements, employer letters, and self-employment accounts must be completed in accordance with the evidence requirements in Appendix FM-SE. The disadvantage is that you have to pay another visa fee and medical surcharge (IHS).

💡 How to choose?
’s official calculation was wrong → Administrative review;
’s income improved after submission/documents were missing but family life was involved → Human rights appeal;
’s income was indeed insufficient but there were harsh consequences → Exception clauses;
just did not have all the documents together → Reapply.

A reminder: no matter which path you take, once the 14/28 day time limit is missed, the right to appeal is gone. The first thing you should do when you get a rejection letter is to clearly read the specific reasons and deadlines written in the rejection letter. Don’t get through the window in confusion. By the way, whether you can successfully transfer to permanent residence (ILR) in the future is directly related to whether your visa has been interrupted in the past few years. You can use the 永居计算器 APP to calculate the number of days of residence and renewal points.
