The answer is: time is indeed short, but the threshold is not "how many years you have lived here", but "what has your company grown into?" This is one of the very few business immigration paths in the UK that still retains the three-year ILR path, and it is also the one that is most likely to overturn in the last step. ⚠️ But a word of warning: the consultation on the "earned settlement" reforms promoted by the Home Office ended on February 12, 2026, with more than 200,000 responses received. Do you see clearly? This is not a standard that can be passed by "I have an app and registered a company." £1 million turnover, 10 full-time positions - this requires you to really build the company within three years. The most commonly used combinations in practice are 1️⃣+3️⃣ (investment + R&D and intellectual property), or 1️⃣+7️⃣ (investment + 5 positions).

Key action: followed the standard and retained evidence from the first year. For recruitment, contracts, payslips, and PAYE records must be kept; for investments, bank flows and uses must be traceable; for R&D, IPO application receipts must be kept. Waiting until the 34th month to start looking through the books is basically too late.

5. The 3 most common pitfalls when starting a business and transferring to permanent residence
