But British law is exactly the opposite - it specifically leaves a channel for immigrant spouses who have suffered domestic abuse to independently obtain status, and even directly obtain permanent residence. Today I will talk about the three things of asking for help, protection and identity in one go.

The first step: personal safety, remember these British emergency telephone numbers

No matter how important the issue of identity is, it ranks second to "being alive and safe". Domestic violence is not just physical, mental control, economic blockade, threats and intimidation, and forced behavior are all clearly recognized as domestic violence in the UK by the "Domestic Abuse Act 2021".

Step 2: Legal protection order to keep him from getting close to you

There are two main types of "isolation orders" that can be issued by British courts:

🛡️ Non-Molestion Order (No-molestation order) : prohibits the other party from using violence, harassment, stalking, and contacting you, usually valid for 6–12 months. Once is violated, it will constitute a criminal offense and the police can arrest him directly.

🏠 Occupation Order : The abuser can be kicked out of the shared residence, even if the house is in the other person’s name.

The application should be submitted to the Family Court via FL401 form . In an emergency, you can apply for "without notice" to be heard on the same day. In addition, the police can also issue a DVPN and apply to the court for a DVPO to provide short-term protection; the Domestic Abuse Protection Order (DAPO) , which will be piloted in some areas starting from 2026, goes further. The protection period is no longer stuck for 28 days, and violations will also be directly punished.

The key point: domestic violence victims who apply for a protection order are usually exempted from the financial test and directly receive Legal Aid . You do not have to pay for a lawyer.

Step Three: Self-rescue for immigration status—MVDAC and permanent residence ILR channel

This is the part that Chinese people are most concerned about and are most likely to be threatened by perpetrators. Two roads need to be distinguished:

MVDAC (Migrant Victims of Domestic Abuse Concession) - It replaces the old DDVC and gives you 3 months of independent legal status , during which you can apply for public benefits (such as Universal Credit, homeless assistance), allowing you to have money and time to break away from the relationship before deciding on the next step. The good news is that the rules are relaxing: now no longer requires you to be "poor" to apply, and the scope of application has also been extended to spouses and family members of work permit, study permit, and graduate visa holders ; starting from March 26, 2026, accompanying children no longer need to meet accommodation, maintenance fees, and language requirements.

SET (DV) Permanent Residence Application (Appendix Victim of Domestic Abuse) - If you last held an Appendix FM spouse visa, a refugee spouse visa or a British military spouse visa, and the relationship was permanently broken down due to domestic violence, you can directly apply for permanent residence (ILR) in without the 5-year residence period requirement . Evidence of domestic violence (alarm records, medical reports, social worker letters, protection orders, etc.) is required.

💷 The SET(DV) permanent residence application fee is approximately and £2,885 (subject to the latest announcement of GOV.UK). But if you have nowhere to live and cannot afford basic living expenses, you can apply for fee waiver (fee waiver) . If you meet the conditions, you can submit it for free. Three things you can do now

2️⃣ Take good care of your UKVI / eVisa account and change your password immediately - don't let the other party control your identity information (this is exactly what the new official guidelines in 2026 emphasize).
3️⃣ Chat with someone who understands immigration law as soon as possible. Calculate your visa type and remaining time clearly, and then decide whether to go for MVDAC or SET(DV).
