"What needs to be reported before the money from selling a house in China is transferred to the UK?" "The procedures for transferring funds from China, verification of the source of funds by the UK bank, and applicable tax declarations all need to be handled. Here, it is divided into two scenarios based on whether the transfer of assets for immigration can be processed."
My judgment is: It is not advisable to commit to a payment date before confirming the remittance route for using the proceeds from selling the house to pay for the UK property.
Eligible for immigration property transfer: Apply for approval first
The current "Interim Measures for the Administration of Foreign Exchange Sales and Payment for Transfer of Personal Property Abroad" Article 2 and the "Guidance on Capital Account Foreign Exchange Business (2024 Edition)" Section 6.4 stipulate the conditions for transfer of property upon immigration. For applicants who are moving to the UK, it is necessary to verify whether they have obtained permanent residency or foreign citizenship, as well as whether the property was owned before obtaining the corresponding status. Applications that meet the criteria should apply for approval to the foreign exchange bureau at their original place of residence, and then proceed to the bank with the approval document to handle the purchase and remittance of foreign currency. Application materials include written application and application form, identity proof, proof of overseas settlement, proof of cancellation of domestic household registration, and proof of property rights and tax matters; the form of the proof should be prepared according to the requirements of the accepting authority.
Here, the focus is on the time when the property was obtained; selling the house after obtaining permanent residency does not result in losing the application eligibility. Having only a permanent residency certificate is not sufficient to complete the entire application.
Not eligible: Verify according to the actual purpose
Only those with a valid UK visa, or those whose intended asset transfer does not meet the above conditions, cannot directly use this route. Actual expenses for study and daily life can be submitted to the bank for review according to purpose and documents; purchasing property overseas is not within the allowed purposes of individual convenience foreign exchange purchase, and it is also not allowed to split the foreign exchange purchase by borrowing relatives' quotas. The source of the house purchase funds should be legal, and the purpose of the current remittance should be approved, and they need to be verified separately.
When verifying, explain the property acquisition date, personal identity, remittance amount and purpose of receipt, and obtain the corresponding list of materials.
The material should be able to connect smoothly to the account.
A statement of the source of funds for the UK receiving bank or real estate lawyer can be organized in this order: original property ownership certificate and purchase contract, followed by the buyer's payment flow, then the seller's receipt, loan repayment and tax deduction, and finally the foreign exchange and cross-border remittance receipt. Each step should indicate the date, amount, and account holder. If the total contract price differs from the net amount received, attach a calculation explanation. Whether Chinese documents need translation or certification should be confirmed with the actual reviewing authority to avoid assuming one institution's requirements as a universal standard.
The foreign exchange bureau's Q&A on May 12, 2026, clearly states: If the property certificate has been confiscated, relevant proof documents from the real estate department, such as file checks, can be provided. This alternative document is very practical.
The SRA's funding sources FAQ lists examples such as bank statements and settlement statements, with the depth of review depending on the risk. Funds gifted by parents after selling their house need to explain the gift relationship and the source of the parents' funds; the documents should clearly state the actual seller and the donor, and should not describe it as proceeds from your own property sale.
UK declaration is verified annually according to the house selling tax.
The UK permanent residency and UK tax residency are different concepts. According to HMRC's guidance on overseas properties, the resident status in the tax year of the property sale, the treatment over years, and applicable exemptions determine the UK tax obligations. Tax residents usually need to assess the capital gains tax on the overseas property sale, calculated based on the gain; taxes already paid domestically can be claimed as credit under certain conditions. When reporting, it is usually handled through the SA108 Capital Gains supplementary form of Self Assessment, and other supplementary forms such as foreign tax credit should be filled out as needed. The exemption for the main residence and the current FIG (Foreign Income and Gains) exemption require separate qualification, and the entire proceeds from the property sale cannot be directly regarded as taxable income.
The bank verification is completed, which does not mean that the HMRC declaration has been completed; The date of the payment arrival does not directly determine the tax year to which the property sale gain belongs.
According to HMRC's HS264 guidance, previously applicable in-coming funds, or un-taxed overseas income or gains, may still have tax implications upon arrival. If the proceeds from selling a property are mixed with such old funds in the same account, it is advisable to provide the tax advisor with annual tax records and complete transaction histories before transferring the money; just looking at the current property sale contract is not enough.
