What to do if your UK rental deposit is withheld: 3-step free rights protection to get your deposit back

First confirm: whether your deposit is "legally protected"

In England, after a landlord receives a deposit, they must deposit it into one of three government-approved Tenancy Deposit Protection (TDP) schemes within 30 days:

• Deposit Protection Service (DPS)
• MyDeposits
• Tenancy Deposit Scheme (TDS)

At the same time, the landlord will give you a "deposit information" (prescribed information), specifying which plan the deposit is in and what number it is. You can directly go to the official websites of these three companies and enter your name and deposit information to check whether your deposit is protected.

Key point: If the landlord did not deposit the deposit into the protection plan at all, you can go to the county court to sue. The court can order the landlord to compensate 1 to 3 times of the amount of your deposit. Which deductions are legal and which are "arbitrary deductions"

If a landlord wants to withhold the deposit, he must have a valid reason.
