Can I get permanent residence in the UK on a dependent visa? What to do if the relationship is broken

JustiScript

Many people think that as a holder of dependent visa (Dependant Visa) as a spouse or child, you can "just follow the main application" when it comes to permanent residence. Once the main applicant has obtained permanent residence, the whole family will automatically come to shore. This understanding is exactly the misunderstanding that makes people wait five years in vain.

The real situation is: dependent visa holders have a permanent residence qualification "of their own", the conditions are calculated independently, and the risks are borne independently. If you don't understand this, you may be stuck when the main application is ashore.

You can also apply for British permanent residence independently if you rely on a visa ILR

Taking Skilled Worker as an example, a dependent visa holder who is the spouse of the main applicant can apply for permanent residence (Indefinite Leave to Remain) as long as he has lived in the UK continuously for 5 years and in a "dependent status" and meets the conditions. It is usually easiest to submit at the same time as the main applicant .

But "at the same time" is not mandatory. If your 5 years have not been completed and the main applicant obtained permanent residence first, you can definitely continue to renew the dependent visa , and then apply separately after you have saved up enough consecutive years of residence. Applying for landing does not mean that you have to rush to follow up.

There is a detail that is easy to miss: when calculating continuous residence, the time you spent under the "dependent status" of can be added up to (for example, from being dependent on one main applicant for a visa to another main applicant for a visa), but the time on your own independent visa (such as your own Skilled Worker), usually cannot be counted into this dependency path . Families whose identities switch back and forth must be checked section by section.

The 180 days of permanent residence and departure abroad are all counted individually: if the main application is passed, you may not be able to pass it.

This is the most hidden and fatal pitfall of relying on a visa to live permanently. The 180-day departure rule for permanent residence (no more than 180 days abroad in any rolling 12-month period) is calculated separately for each person in and - the number of days in the main application belongs to the main applicant, and the number of days in your application belongs to you.

In reality, family members often travel at different paces: the main applicant works in the UK, but the spouse often takes the children back to visit relatives, accompany them to study, and take care of the elderly. The result is that the main application of has steadily met the standard, but the relying party has exceeded the 180 days of , and the permanent residence has been rejected. Submitting as a family does not mean that you will pass the customs together.

Suggestion: Each visa holder in the family keeps an "exit account", don't just focus on the main applicant. With the 永居计算器 APP, you can calculate the exact number of days per person, and you can see who is close to exceeding the standard at a glance.

If the relationship breaks down or the main applicant applies to leave, will the dependent visa permanent residence still exist?

The foundation of relying on a visa is "relationship" and "the legal status of the principal applicant". Once shaken, the path to permanent residence will also change:

👉 Divorce or separation: Your basis for residence as a dependent disappears when the relationship ends. Usually the Ministry of Interior will give you 60 days to allow you to switch to other paths (such as finding a sponsored employer to switch to Skilled Worker, or applying for a family visa with children) or leaving the country.

👉 main applicant loses his job or leaves the UK: When the main applicant visa is curtailed, the dependent visa is usually curtailed at the same time as and , and you also have about a 60-day window to find another way out. The number of years of residence saved during this period may be "stopped".

👉 encounters domestic violence: If the breakdown of the relationship involves domestic violence, as the dependent party you may be eligible to apply for permanent residence alone through the domestic violence provisions (Domestic Violence related provisions) , without being trapped in a dangerous relationship for fear of losing your identity. This is important protection, don’t do it alone.

Hard conditions for permanent residence for dependent visa holders

Don't forget, the dependent party also needs to pass the test when applying for permanent residence, and cannot "free ride" on the main applicant:

① The English language has reached CEFR B1 and above (or English-taught degrees are exempted); ② Passed Life in the UK Test; ③ The relationship truly exists at the time of submission and both parties have the intention to live together; ④ Meet their respective requirements for continuous residence and exit. Every dependent adult must meet these standards one by one.

Also note: The "Earned Settlement" proposed in the 2025 white paper plans to extend the length of some work paths to 10 years. The consultation ended on February 12, 2026, and there is no official effective date yet. Please refer to the latest announcement of GOV.UK for specific rules.
