Council Tax student exemption: first depends on whether you are considered "full-time"
The legal basis is Local Government Finance Act 1992 and the supporting Council Tax (Discount Disregards) Order. To be considered "disregarded" as a full-time student, a course must meet three criteria:
✅ Course duration ≥ 1 academic year (or calendar year)
✅ At least 24 weeks of teaching per year
✅ Average study time ≥ 21 hours per weekMany master's, bachelor's, and doctoral programs can meet this requirement; however, language classes, part-time, and weekend classes often do not meet the 21-hour threshold, so is not included in the exemption range. If you are not sure whether you can count, it is safest to ask for an Council Tax Exemption Certificate from the school’s student services.
The whole house is full of students = no payment at all Council Tax
This is the cheapest scenario. If all adult residents in the house are full-time students , the entire house is exempted - private rentals go to the Class N exemption category, and student dormitories (halls of residence) go to the Class M exemption category. The latter is usually automatically exempted without even applying.
But note: exemption will not automatically credit . For private rentals, you must actively submit a student certificate to the council where you are applying, otherwise the system will default to you having to pay, and the bill will be sent and the reminder letter will come.
Are students and non-students living together? Get 25% discount
Students being "ignored from the count" means that when counting how many "taxable adults" live in this apartment, students are not included. Overseas spouse/accompanying family member, how to calculate Council Tax?
This is the most common pitfall for Chinese families. The rules are clear: the student's spouse or dependents will also be disregarded (ignored from counting) as long as they are "non-British citizens + visa terms prohibiting them from working or receiving benefits" .
This means that a family consisting of a full-time student + an overseas spouse who cannot work due to visa restrictions can still be exempted from as Class N, and theoretically does not need to pay Council Tax. When applying, you need to submit two things to the council: a certificate of enrollment from the school, and materials that prove that the spouse's visa is "prohibited from working/prohibited from receiving benefits" (such as the condition description on the visa vignette or eVisa).
⚠️ Key difference: If your spouse’s visa allows you to work (even if you are not working), you are not eligible for this exemption. At this time, the family can often only get a 25% discount instead of a full exemption. Read the conditions of your own visa word for word and don’t take them for granted.
Get back the money you saved in three steps
① Go to your local council official website to find the Council Tax discount/exemption page; ② Prepare proof of enrollment and visa terms; ③ Submit online and keep the receipt. The discount can usually be traced and to the date of meeting the conditions. Any overpayments in the past may be refunded, so don’t just apply now.
